Common use of Beta Services Clause in Contracts

Beta Services. From time to time, PCS may make Beta Services available to Customer at no charge. Customer may choose to try such Beta Services or not in its sole discretion. Beta Services are intended for evaluation purposes and not for production use, are not supported, and may be subject to additional terms. Beta Services are not considered “Services” under this Agreement, however, all restrictions, PCS’s reservation of rights and Customer obligations concerning the Services, and use of any related Non-PCS Applications, shall apply equally to Customer’s use of Beta Services. Unless otherwise stated, any Beta Services trial period will expire upon the earlier of one year from the trial start date or the date that a version of the Beta Services becomes generally available without the applicable Beta Services designation. PCS may discontinue Beta Services at any time in PCS’s sole discretion and may never make them generally available. PCS will have no liability for any harm or damage arising out of or in connection with a Beta Service.
