BEP Goals. 2.18.1 Contractor shall meet the BEP subcontracting goals set by the Department. The Department shall notify the Contractor of the goal at least ninety (90) days prior to February 1, 2014, and prior to the start of each subsequent State fiscal year, which begins on July 1 of each calendar year. The goal will be set as percentages of the Administrative Allowance, multiplied by the anticipated Enrollee months during the State fiscal year. Changes to the BEP subcontracting goal may be made without amendment to the Contract if agreed to in writing by the Department and the Contractor. The percentages for the goals shall be twenty percent (20%) of the Administrative Allowance. 2.18.2 Prior to the start of each State fiscal year, the Contractor shall submit a BEP Utilization Plan for such State fiscal year, as a required report to the Department in a format specified by the Department, and such report being incorporated as a part of this Contract, sufficient to demonstrate compliance with the goals set by the Department for such State fiscal year. The first BEP Utilization Plan shall be due on December 1, 2013, and on June 1 prior to the start of each subsequent State fiscal Year. The Contractor shall provide the Department with a quarterly report regarding the Contractor’s status of meeting the goal. The Contractor shall maintain a record of all relevant data with respect to the utilization of BEP certified subcontractors, including, but not limited to, payroll records, invoices, canceled checks and books of account, for a period of at least five (5) years after the completion of the Contract.
