Benevolent Clause Samples
A 'Benevolent' clause typically requires one party to act in good faith and with consideration for the interests of the other party during the performance of the contract. In practice, this may obligate a party to avoid actions that would unfairly disadvantage the other, such as withholding necessary information or failing to cooperate when required. The core function of this clause is to foster trust and cooperation between the parties, reducing the risk of opportunistic behavior and disputes arising from bad faith actions.
Benevolent accounts are subject to all of the other terms of this Agreement, but include the following special restrictions:
Benevolent. Members of this bargaining unit shall be eligible to participate in the Benevolent Fund under the terms and conditions established by Article 47 of the other Bargaining Unit Agreement, as may be amended from time to time. After the ratification of this Agreement, the Benevolent Fund shall provide a supplemental open enrollment period for all current employees. The terms and conditions for this supplementary open enrollment period shall be determined by the Benevolent Fund.
