Common use of Benefit Status Clause in Contracts

Benefit Status. A. The salary and benefit provisions contained within this Memorandum of Understanding are granted only to employees who are in a current pay status when the City Council adopts the MOU. The City shall incur no cost nor shall benefits accrue for retirees, survivors, or employees in a non-pay status. Family Leave and Military Leave, however, shall be granted in accordance with the applicable provisions of State and Federal law. B. In the event an employee is in a non-pay status because of a disputed workers’ compensation claim, benefits under this article shall be continued upon written agreement of the affected employee to repay to the City the amount of any premiums paid by the City during the non-pay status period if the employee’s claim is denied by the Workers’ Compensation Appeals Board or withdrawn by the employee prior to a decision by the Board.
