Behind Programme. 10.2.1. If at any time the Company considers that the Contractor will not be able to comply with the Contract Programme the Company may, in addition to and not in substitution for the other rights of the Company under the Contract, direct the Contractor to supply additional suitable and sufficient labour (including Sub-Contractors), supervision and Plant and Equipment to maintain the Production Rate and otherwise comply with the Contract Programme. 10.2.2. The Contractor must promptly comply with any direction from the Company under clause 10.2.1. The Contractor’s obligation to supply such additional labour, supervision and Plant and Equipment will cease only when the Contractor is in compliance with the Contract Programme. 10.2.3. This clause 10.2 is without limitation to the Contractor’s right to claim a variation to the Contract Programme and if any such claim is successful the Contractor shall be entitled to claim in accordance with clause 27.4 the Costs of the Contractor in complying with the Company’s direction under this clause.
