Common use of Behavioral Reassignment Seats Clause in Contracts

Behavioral Reassignment Seats. Contractor shall provide a total of 85 Behavioral Reassignment seats for MPS pupils in grades 6-8. All of these 85 Behavioral Reassignment seats shall be filled by the MPS Department of Student Services and/or MPS Department of Specialized Services as needed throughout the school year. None of these 85 Behavioral Reassignment seats shall be reserved for provision of comprehensive behavioral support services and shall be filled by MPS Department of Specialized Services as needed throughout the school year. Contractor shall be paid for these Behavioral Reassignment seats even if they are not filled by MPS. In consideration of the possibility of receiving payment from MPS for Behavioral Reassignment seats that are not filled by MPS, Contractor shall immediately admit any pupil referred by MPS for temporary assignment by the MPS Department of Student Services, (up to 10% of the number of Behavioral Reassignment seats contracted for under this paragraph) until a permanent assignment is found by MPS for the pupil.
