Common use of Aviation Clause in Contracts

Montana state aircraft are not approved for use by federal agencies. Under emergency circumstances, where human life is immediately at risk by wildfire on federal lands under federal protection, a federal line officer can approve the use of non-federally approved aircraft to address the immediate threat. This exemption must only take place when sufficient federal aircraft are not readily available to meet the emergency need.
