Common use of Availability for Duty Clause in Contracts

Availability for Duty. 16.1.1 Availability for Duty shall mean that the Employee concerned shall be available to the Employer by means of telephone at all times that Employee is rostered for such duty. Should an employee fail to respond to a call within a fifteen minute period whilst they are on Availability for Duty, unless in the event of extenuating circumstances, the employee will not be eligible for the allowance. 16.1.2 Where an Employee is on Availability for Duty, the Employee shall be paid Availability for Duty Allowance in accordance with Schedule 2 of Appendix A. If required to work employees shall be paid at the appropriate rates of pay for actual time worked. In the case of a single call out the employee shall be paid a minimum of three hours. 16.1.3 Actual time worked shall mean the time taken from the Employee first receiving notification of a requirement to work until the time that the Employee has returned home after such work. Time spent travelling to and from a job will be considered time worked. 16.1.4 Any technical or, other work related phone call shall be treated as actual time worked for the purpose of this clause acknowledging the rest period shall not be provided. Incidental and/or non-work related calls shall not constitute a call-out for the purposes of this clause. 16.1.5 A rest period shall be provided to employees when attending to call outs for the actual time worked between midnight and 6am on a weekday (Monday to Friday), under the following conditions:

Rest Period after Call Out Where an Employee is required to employees when attending to call outs for the actual time worked work between midnight 12.00am (midnight) and 6am 5.00am on a weekday (Monday to Friday)) the Employee shall be provided a rest period for the actual time worked during that period, under the following conditions:condition: ▪ The rest period shall begin at the ordinary start time that same day (i.e. if the Employee normally starts work at 7.30am and, gets called out from 1.30am until 4.00am, they are entitled to a rest period (without loss of pay) from 7.30am until 10.00am that same morning).
