Authorized contractor. As used in this Attachment, the term “Authorized Contractor” is used when referring to any contractor included on a list of contractors provided by AT&T and which, subject to Attaching Party’s direction, control, and the requirements and policies in each state, performs facilities modification, Make-Ready Surveys, or Make-Ready Work which would ordinarily be performed by AT&T, Other User, or persons acting on AT&T’s or Other User’s behalf, respectively. AT&T shall make available, and keep up-to-date, a reasonably sufficient list of contractors, identified by the applicable electric utility, to perform Make-Ready Work above the Communications Space on AT&T’s Poles. Additionally, AT&T shall make available, and keep up-to-date, a reasonably sufficient list of contractors it authorizes to perform Make-Ready Surveys or Make-Ready Work in the Communications Space on its Poles in cases where, in accordance with this Agreement, Attaching Party has elected One-Touch Make-Ready (OTMR) or AT&T and/or Other User(s) failed to meet the associated deadlines specified in Section 8 of this Agreement, with the following exclusions: 2.3.1 A person or entity identified as an Authorized Contractor is only an Authorized Contractor with respect to those tasks for which such person or entity has been listed and is an Authorized Contractor only in those states specified by AT&T on such list.
