Common use of Attorneys’ Fees and Other Costs Clause in Contracts

Attorneys’ Fees and Other Costs. In the event of any action, including but not limited to litigation, arbitration, or other similar proceedings, because of any alleged breach of this Agreement, the prevailing party (-ies) shall be entitled to an award of his or its/their reasonable attorney fees and costs incurred in the action, including but not limited to any fees and costs associated with expert witnesses and litigation consultants, and the costs and fees associated with the appeals, collection, or enforcement of any judgment or order of court resulting therefrom. To so recover, it shall not be necessary that the prevailing party (-ies) prevail in each and every claim or defense. Payment of such attorney fees and/or costs shall be made within sixty (60) days after the prevailing party has been determined.
