Common use of Assurance of Future Performance Clause in Contracts

Assurance of Future Performance. Tenant’s trustee or the debtor-in-possession provides Landlord with Assurance of the future performance of the obligations of Tenant under the Lease, Tenant’s trustee or the debtor-in-possession, and if that Assurance has been provided, Tenant’s trustee or the debtor-in-possession shall also (i) deposit with Landlord, as security for the timely payment of Rent under this Lease, an amount equal to three (3) months’ Base Rental, and (ii) pay in advance to Landlord on the date that Base Rental is due and payable, one-twelfth (1/12) of Tenant’s annual obligations for any other purpose (e.g., taxes and insurance) pursuant to this Lease. The obligations imposed on Tenant’s trustee or the debtor-in-possession shall continue with respect to Tenant or any assignee of this Lease after the completion of bankruptcy proceedings.
