Arial. 4.3 The Contractor shall (in addition to the requirements of paragraph 00(e) above) identify and inform the Authority of any Results which it considers suitable for commercial exploitation. Where the Contractor has identified an opportunity for the commercial exploitation of the Results then it may either apply to the Authority for such licence (with a right to sub-license as required) as may be necessary, or provide such assistance as is required by the Authority to facilitate a licence being granted by the Authority to a third party.
Arial. 5.2 The Contractor recognises and acknowledges for the purposes of paragraph 00(c) above that Key Biological Materials in its possession are likely to require long term maintenance and shall put in place appropriate procedures for ensuring that relevant samples are selected for this purpose where applicable.
Arial. 5.3 It shall be the sole responsibility of the Contractor to identify any requirements of the Conventions (including, without limitation, benefit-sharing requirements arising from use of Biological Materials) which may apply in connection with the Services. The Contractor shall comply with any such requirements and inform the Authority of the same. Final length and welding of the second end flange will be done on site to complete the new pipe runs.

Arial. For the purpose of this Agreement, the term "grievance" means any dispute between the Port and the Union; or between the Port and any employee concerning the effect, interpretation, application, claim of breach, or violation of this Agreement; or any dispute that may arise between the parties. All grievances not mentioned within fifteen (15) days after they occur, or first knowledge that a grievance exists, shall be considered as outdated, thus preventing an accumulation of grievances.
