Arbitration Optional. If mediation fails to resolve a claim, dispute or other matter in question between the parties, then the parties may mutually agree to submit their claim, dispute or other matter in question to binding or non-binding arbitration.
Arbitration Optional. If mediation fails to resolve the dispute, either party may elect to refer the matter to binding arbitration, in accordance with the Arbitration Act of South Africa. The arbitration shall be conducted by a single arbitrator agreed upon by the parties, or, failing agreement, appointed by the Arbitration Foundation of Southern Africa (AFSA). The decision of the arbitrator will be final and binding, and judgment on the award rendered may be entered in any court having jurisdiction.
