Common use of Arbitration Notification Clause in Contracts

Arbitration Notification. ‌ (a) Where a difference arising between the parties relating to the interpretation, application, or administration of this agreement, including any question as to whether a matter is arbitrable, or where an allegation is made that a term or condition of this agreement has been violated, either of the parties may, after exhausting the grievance procedure in this article, notify the other party within thirty (30) days of the receipt of the reply at the third step, of its desire to submit the difference or allegations to arbitration. (b) Each party shall pay its own costs and expenses of the arbitration and one-half (½) of the remuneration, disbursements or expenses of the Arbitrator. When an arbitration board is required, each party shall be responsible for any costs associated with its respective member, plus one-half (½) the costs of the Chairperson and the proceedings of the arbitration.
