Approval by SBA. An entity may not submit Pool applications to the FTA until SBA has approved the appli- cation to become a Pool Assembler.
Approval by SBA. This Adherence Agreement will be effective as of the date hereof but will be subject to approval by SBA as hereinafter provided and to renegotiation in the event that SBA at any time determines that renegotiation is appropriate. A fully executed copy of this Agreement will be filed with SBA within 30 days after the date hereof. Following receipt of such executed copy of this Agreement, SBA will have, pursuant to Section 107.801 of the SBA Regulations, 90 days within which to notify the SBICs that the amendment of the Plan of Divestiture provided herein has not been approved. In the absence of such notice, this Agreement and the amendment of the Plan of Divestiture contained herein will be deemed to have been approved by SBA.

  • Approval by Shareholders The Trust will call a meeting of the shareholders of the Selling Fund to consider and act upon this Agreement and to take all other action necessary to obtain approval of the transactions contemplated herein.

  • Approval of Plan Approval of the Plan by the Commissioner of Internal Revenue as referred to in 17.1 means a continuing approval sufficient to establish that the Plan and related trust(s) are at all times qualified and exempt from income tax under Section 401(a) and other applicable provisions of the Internal Revenue Code of 1986, and that contributions made by the Company under the Plan are deductible for income tax purposes in accordance with law. The cognizant governmental authorities referred to in 17.1 include, without limitation, the Department of Labor, the Pension Benefit Guaranty Corporation and the Securities and Exchange Commission, and their approval means their confirmation with respect to any matter within their regulatory authority that the Plan does not conflict with applicable law.
