Apple App Store. If you obtained the App from the Apple App Store, you and AFC acknowledge and agree that (to the full extent permitted by applicable law):
Apple App Store. In the event of Our failure to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price for the Mobile App. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, APPLE WILL HAVE NO OTHER WARRANTY OBLIGATION WHATSOEVER WITH RESPECT TO (A) THE MOBILE APP AND (B) ANY OTHER CLAIMS, LOSSES, LIABILITIES, DAMAGES, COST, OR EXPENSES ATTRIBUTABLE TO ANY FAILURE TO CONFIRM TO ANY WARRANTY.
Apple App Store. If the EasyAnatomy App is provided to User for download through the Apple Inc. (Apple Inc. together with all of its affiliates, “Apple”) App Store, the following terms and conditions shall apply: (i) LlamaZOO and User acknowledge that this Agreement is concluded between LlamaZOO and User, and not with Apple, and that, as between LlamaZOO and Apple, LlamaZOO is solely responsible for the EasyAnatomy App and the content thereof; (ii) notwithstanding anything to the contrary hereunder, User may use the EasyAnatomy App only on an Apple-branded product or device that runs iOS and as permitted by the “Usage Rules” set forth in the Apple Store Terms of Service; (iii) LlamaZOO and User acknowledge that Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the EasyAnatomy App; (iv) in the event of any failure of the EasyAnatomy App to conform to any applicable warranty, User may notify Apple, and Apple will refund the purchase price for the EasyAnatomy App (if any) to User. Except for the foregoing, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the EasyAnatomy App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be the sole responsibility of LlamaZOO to the extent required by this Agreement; (v) LlamaZOO and User acknowledge that Apple is not responsible for addressing any claims of User or any claims of any third party relating to the EasyAnatomy App or User’s possession and use of the EasyAnatomy App, including but not limited to: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection or similar legislation; (vi) LlamaZOO and User acknowledge that, in the event of any third party claim that the EasyAnatomy App or User’s possession and use of the EasyAnatomy App infringes that third party’s intellectual property rights, LlamaZOO will be solely responsible for the investigation, defense, settlement and discharge of such intellectual property infringement claim to the extent required by this Agreement, and Apple will have no responsibility for the foregoing; (vii) User represents and warrants that User is not:

  • Unbundled Sub-Loop Feeder 2.8.4.1 Unbundled Sub-Loop Feeder (USLF) provides connectivity between BellSouth's central office and cross-box (or other access point) that serves an end user location.

  • Unbundled Sub-Loop Distribution Intrabuilding Network Cable (USLD-INC) is the distribution facility owned or controlled by BellSouth inside a building or between buildings on the same property that is not separated by a public street or road. USLD-INC includes the facility from the cross connect device in the building equipment room up to and including the point of demarcation at the End User’s premises.

  • Unbundled Digital Loops 2.3.1 BellSouth will offer Unbundled Digital Loops (UDL). UDLs are service specific, will be designed, will be provisioned with test points (where appropriate), and will come standard with OC and a DLR. The various UDLs are intended to support a specific digital transmission scheme or service.

  • Dark Fiber Loop 2.8.4.1 Dark Fiber Loop is an unused optical transmission facility, without attached signal regeneration, multiplexing, aggregation or other electronics, from the demarcation point at an End User’s premises to the End User’s serving wire center. Dark Fiber Loops may be strands of optical fiber existing in aerial or underground structure. BellSouth will not provide line terminating elements, regeneration or other electronics necessary for AFN to utilize Dark Fiber Loops.

  • Loop Provisioning Involving Integrated Digital Loop Carriers 2.6.1 Where EveryCall has requested an Unbundled Loop and BellSouth uses Integrated Digital Loop Carrier (IDLC) systems to provide the local service to the end user and BellSouth has a suitable alternate facility available, BellSouth will make such alternative facilities available to EveryCall. If a suitable alternative facility is not available, then to the extent it is technically feasible, BellSouth will implement one of the following alternative arrangements for EveryCall (e.g. hairpinning):

  • Wire Unbundled DS1 Digital Loop This is a designed 4-wire Loop that is provisioned according to industry standards for DS1 or Primary Rate ISDN services and will come standard with a test point, OC, and a DLR. A DS1 Loop may be provisioned over a variety of loop transmission technologies including copper, HDSL-based technology or fiber optic transport systems. It will include a 4-Wire DS1 Network Interface at the End User’s location.

  • Computer Equipment Recycling Program If this Contract is for the purchase or lease of computer equipment, then Contractor certifies that it is in compliance with Subchapter Y, Chapter 361 of the Texas Health and Safety Code related to the Computer Equipment Recycling Program and the Texas Commission on Environmental Quality rules in 30 TAC Chapter 328.

  • Unbundled Copper Sub-Loop (UCSL) is a copper facility of any length provided from the cross-box in the field up to and including the End User’s point of demarcation. If available, this facility will not have any intervening equipment such as load coils between the End User and the cross-box.
