Amendment to Capital Expenditures Covenant. Section 7.15 of the Credit Agreement shall be amended and restated in its entirety to read as follows:
Amendment to Capital Expenditures Covenant. Section 18.4 of the Loan Agreement shall be amended by deleting the words "in the calendar quarter ending December 31, 1993, in an aggregate amount exceeding Two Million Five Hundred Thousand Dollars ($2,500,000) and in any calendar year thereafter, in an aggregate amount exceeding Seven Million Dollars ($7,000,000)" beginning in the second line therein and substituting the following therefor: "in the calendar year ending December 31, 1997, and in any calendar year thereafter, in an aggregate amount exceeding Twenty Million Dollars ($20,000,000)".
Amendment to Capital Expenditures Covenant. Section 8.2.8 of the Loan Agreement is hereby amended by deleting the reference therein to "$3,000,000" (which reference was added by the Second Amendment to the Loan Agreement) and substituting therefor a reference to "$12,000,000".
Amendment to Capital Expenditures Covenant. Section 6.17 of the Loan Agreement is hereby amended to read in full as follows:
Amendment to Capital Expenditures Covenant. As of the Seventh Amendment Date Article 7 of the Loan Agreement is hereby amended to amend and restate Subsection 7.6 in its entirety as follows:
Amendment to Capital Expenditures Covenant. Section 10.16 of the Credit Agreement is hereby amended by deleting the table set forth in such section in its entirety and by replacing it with the following new table: "Period Maximum Capital Expenditures ------- ---------------------------- Closing Date through $11,000,000 December 31, 2000 Fiscal Year ending $15,000,000 December 31, 2001 Fiscal Year ending $6,000,000 December 31, 2002 Fiscal Year ending $6,000,000 December 31, 2003 Fiscal Year ending $6,000,000" December 31, 2004 The parties acknowledge and agree that the paragraph immediately following such table in Section 10.16 shall remain in full force and effect without modification.
Amendment to Capital Expenditures Covenant. Section 6.13 of the Loan Agreement is hereby amended by deleting the reference therein to "$750,000" and substituting therefor a reference to "$850,000".
Amendment to Capital Expenditures Covenant. Section 7.1.28 of the Credit Agreement is deleted and replaced with the following provision:
Amendment to Capital Expenditures Covenant. Section 8.2 of the Credit Agreement is hereby amended by adding the following sentence at the end thereof: "In addition to the foregoing annual limitations, the Borrower shall not, nor shall it permit any of its Subsidiaries to, directly or indirectly, make or incur any Capital Expenditures, in the aggregate for the Borrower and its Subsidiaries combined, in excess of (a) $2,400,000 during the one month period ending February 7, 2004, (b) $3,000,000 during the consecutive two month period ending March 6, 2004 or (c) $3,400,000 during the consecutive three month period ending April 3, 2004."
