Amendment/Standardized Plan Clause Samples

The Amendment/Standardized Plan clause establishes the process by which changes or updates can be made to an existing agreement or plan. Typically, this clause outlines the requirements for making amendments, such as requiring written consent from all parties or specifying a formal procedure for proposing and approving modifications. For example, it may state that any changes to the terms must be documented and signed by both parties to be valid. The core function of this clause is to ensure that any alterations to the original agreement are made transparently and with mutual agreement, thereby preventing misunderstandings or disputes over unauthorized changes.
Amendment/Standardized Plan. The Employer in its Standardized Plan may not amend any provision of Article VIII (or any other provision of the Plan related to the Trust) except the Employer in Appendix C (or in its Adoption Agreement as applicable) may specify the Trust year, the names of the Plan, the Employer, the Trustee, the Custodian, the Plan Administrator, other fiduciaries or the name of any pooled trust in which the Trust will participate.
