ALLOWABLE NECESSITY Clause Samples

The Allowable Necessity clause defines circumstances under which a party is permitted to take certain actions that would otherwise be restricted, provided those actions are necessary to fulfill contractual obligations or comply with legal requirements. For example, this clause might allow a contractor to deviate from specified procedures if such deviation is essential to prevent harm or meet urgent regulatory demands. ALLOWABLE NECESSITY. Any leave in which the bargaining unit member remains in a paid status; such leave can include, but not be limited to , a doctor’s authorized medical leave, pregnancy disability leave, catastrophic leave, bereavement leave, jury duty, personal leave, personal necessity, and industrial accident leave. In addition to the above mentioned leaves, a call to active military service falls under the definition of Allowable Necessity.
