Common use of Allocation of Risk Clause in Contracts

Allocation of Risk. The parties agree that the allocation of risk in this Agreement is reflected in the level of fees payable under this Agreement.

The parties acknowledge and agree that the amounts charged or paid in this Agreement reflect an allocation of risk between the parties, including, but not limited to, the limitation of liability and exclusion of remedies described in this Agreement.
