Allocation of Additional Hours. 14:01 Part-time employees who indicate in writing to the Employer that they wish to work additional hours and submit intent on availability (re: location and day) shall be offered such work, when available provided they are able to perform the required duties. Hours of work due to illness, injury, family leave, compassionate leave or short term absences shall be prioritized as follows: (a) Offered on a seniority basis to employees normally assigned to that school who are not eligible for overtime. (b) Offered on a seniority basis to part-time employees who are not eligible for overtime. (c) Offered to casual employees. Such additional hours shall not overlap with the existing shift of the part-time employee. 14:02 Hours worked in addition to an employee’s regular hours as a result of additional allocation or weekend events which are scheduled in advance shall not be considered call-out but shall be paid at the appropriate rate in accordance with this Agreement. Allocation of Additional Hours. Where possible, any additional hours (above the base rostered hours) will be offered to permanent Employees who can demonstrate the skills to do the task(s), based on the requirements of the Company at any given time, before a casual Employee is engaged. Casual Employees can be used in unforeseen circumstances and emergencies.

  • Payment of Additional Costs If termination of this contract is due to the failure of the Engineer to fulfill its contract obligations, the State may take over the project and prosecute the work to completion, and the Engineer shall be liable to the State for any additional cost to the State.

  • Reasonable Additional Hours 72.1 Subject to subclause 72.2, an Employer may require an Employee to work reasonable additional hours at the appropriate overtime rate as defined in clause 69(Overtime) of the Agreement. 72.2 An Employee may refuse to work overtime in circumstances where the working of such overtime would result in the Employee working hours which are unreasonable having regard to: (a) any risk to Employee health and safety arising from the additional hours; (b) the Employee's personal circumstances, including family responsibilities; (c) the needs of the workplace or enterprise in which the Employee is employed; (d) whether the Employee is entitled to receive overtime payments, penalty rates or other compensation for, or a level of remuneration that reflects an expectation of, working additional hours (e) the notice (if any) given by the Employer of the overtime and by the Employee of his or her intention to refuse it; (f) the usual patterns of work in the industry, or the part of the industry, in which the Employee works; (g) the nature of the Employee’s role, and the Employee’s level of responsibility; (h) whether the additional hours are in accordance with an averaging arrangement agreed to by the Employer and Employee under clause 59 (Hours of Work); and (i) any other relevant matter.

  • Designation of Additional Accounts The Seller hereby delivers herewith a computer file or microfiche or written list containing a true and complete list of all such Additional Accounts specifying for each such Account, as of the Additional Cut-Off Date, its account number, the aggregate amount of Receivables outstanding in such Account and the aggregate amount of Principal Receivables in such Account. Such file or list shall, as of the date of this Assignment, supplement Schedule 1 to the Agreement.

  • Additional Hours Employees who are required to work additional hours beyond their working week are entitled to receive enhancements on the following basis: Monday to Saturday Time and a half Sundays and Public and Extra Statutory holidays Double time (min 2 hours) (Part-time employees are entitled to these enhancements only at times and in circumstances in which full-time employees in the establishment would qualify. Otherwise a full working week for full-time employees shall be worked by a part-time employee before these enhancements apply).

  • Determination of Adjustments If any questions will at any time arise with respect to the Exercise Price or any adjustment provided for in Section 4.8, such questions will be conclusively determined by the Company’s Auditors, or, if they decline to so act any other firm of certified public accountants in the United States of America that the Company may designate and who will have access to all appropriate records and such determination will be binding upon the Company and the Holders of the Warrants.
