Common use of Alcohol Tests Clause in Contracts

Alcohol Tests. When alcohol testing is required a trained breath alcohol technician shall administer a breath test to determine whether there is an alcohol concentration of 0.02 or greater. Any breath test with a result of 0.02 or greater shall be followed with a confirmatory test within fifteen minutes. The costs of the reasonable suspicion drug tests shall be paid by the Town. Any return to duty tests shall be paid for by the town. VIOLATIONS OF THIS POLICY An employee who refuses to submit to a test, tests positive for a controlled substance and/or an alcohol concentration of 0.02 or greater under the tests described above shall be subject to discipline, up to and including dismissal. Discipline other than dismissal may include but shall not be limited to the following:
