Common use of Airspace Clause in Contracts

Airspace. The City reserves the right to take such action it considers necessary to protect the aerial approaches to the Airport against obstruction, together with the right to prevent Lessee from erecting or permitting to be erected any building or other structure in the Airport which, in the opinion of the Airport, would limit the usefulness of the Airport or constitute a hazard to aircraft. Except to the extent required for the performance of any obligations of the Lessee hereunder, nothing in this Agreement shall grant to Lessee any rights whatsoever in the airspace above the Leased Premises other than those rights which are subject to Federal Aviation Administration (or other successor agency) rules, regulations and orders currently or subsequently effective.
