Common use of Airspace Clause in Contracts

Airspace. City hereby reserves for the use and benefit of the public, the right of aircraft to fly in the airspace overlying the land herein leased, together with the right of said aircraft to cause such noise as may be inherent in the operation of aircraft landing at, taking off from, or in the vicinity of the Airport, and the right to pursue the operations of same. City reserves the right to take any action it considers necessary to protect the aerial approaches of the Airport against obstructions, together with the right to prevent Concessionaire from erecting or permitting to be erected, any building or other structure on any Leased Premises, which, in the opinion of City, would limit the usefulness of the Airport, or constitute a hazard to aircraft.
