Common use of Agreement Contingencies Clause in Contracts

Agreement Contingencies. This Agreement is contingent upon: a) The availability of the Equipment and related parts and accessories. b) The net meter installation as set forth in Section 8 (for Solar Energy Production System Work). c) The successful attainment of the necessary building, mechanical, and/or electrical permits from all applicable jurisdictions (city, county, or state). If the Company is unable to commence Work due to permitting issues, this Agreement shall be null and void and the Company will refund to Client the Payments received less the costs of work already performed and a fee not to exceed $500.00 (the 'Administrative Fee'). The Administrative Fee shall cover administrative costs associated with the Company’s efforts to obtain proper permitting. d) For a Scope of Work that includes a Solar Energy Production System, this Agreement is contingent upon acceptance of the Utility Interconnection Application by the local utility. If the Utility Interconnection Application is rejected by the local utility, this Agreement shall be null and void and the Company will return to Client Payments received less a fee for actual time incurred at the Company’s usual billing rate for such application (the 'Utility Application Fee'). The Utility Application Fee shall cover administrative costs associated with the Company’s efforts to obtain all necessary approvals for the Utility Interconnectiong Application, plus any non-refundable rebate deposits or other application fees made by the Company on behalf of Client.
