Agent Duties. Agent agrees to provide the Premises in a fit and habitable condition. If at the time Tenant is to begin occupancy of the Premises, Agent cannot provide the Premises in a fit and habitable condition or substitute a reasonably comparable property in such condition, Agent shall refund to Tenant all payments made by Tenant. Agent shall conduct all brokerage activities in regard to this Agreement without respect to the race, color, religion, sex, national origin, handicap or familial status of any tenant.

Agent Duties. Pursuant to provisions of NCGS 42A-11, it is hereby stated that in the event the Landlord cannot provide the premises described above in a fit and habitable condition on the date the Tenant is to take possession, Tenant shall be entitled to a full refund only, unless travel insurance was offered and declined.

The Agent shall not be liable for failure to collect or realize upon any or all of the Obligations or Collateral, or for any delay in so doing, nor shall the Agent be under any duty to take any action whatsoever with regard thereto. The Agent shall have no duty to comply with any recording, filing, or other legal requirements necessary to establish or maintain the validity, priority, or enforceability of, or the rights of the Agent in or to, any of the Collateral.

Expedited Eviction. If the tenancy created hereunder is for 30 days or less, the expedited eviction procedures set forth in Article 4 of the North Carolina Vacation Rental Act will apply, which provisions are incorporated herein by reference. Upon compliance, Tenant may be evicted under such procedures if Tenant: (i) holds over in possession after Tenant’s tenancy has expired, (ii) commits a material breach of any provision of this Agreement (including any addendum hereto) that according to its terms w ould result in the termination of Tenant’s tenancy (a material breach of this Agreement includes, but is not limited to, any violation of Section 8(j) hereof), (iii) fails to pay rent as required by this Agreement, or (iv) has obtained possession of Premises by fraud or misrepresentation. If the tenancy created hereunder is for more than 30 days, the summary judgment procedures set forth in Article 3 of Chapter 42 of the North Carolina General Statues will apply. Mandatory Evacuation. If State or local authorities order a mandatory evacuation of an area that includes the Premises, Tenant shall comply with the order. Upon compliance, Xxxxxx will be entitled to the prorated rent for each night that the Tenant is unable to occupy the Premises because of the order.

Agent Duties. The Agent shall be obliged to perform only such duties as are specifically set out in this Agreement or in the Conditions and any duties necessarily incidental to them. No implied duties or obligations shall be read into any such documents. The Agent shall not be obliged to perform additional duties set out in any Final Terms and thereby incorporated into the Conditions unless it shall have previously agreed in writing to perform such duties. If, on or after a date on which the Agent accepts any appointment, the Conditions are amended in a way that affects the duties expressed to be performed by it, it shall not be obliged to perform such duties as so amended unless it has first approved the relevant amendment. The Agent shall not be under any obligation to take any action under this Agreement that it expects, and has so notified the Issuer and the Guarantors in writing, will result in any expense to or liability of the Agent, the payment of which is not, in its opinion, assured to it within a reasonable time. The Agent shall not bear the responsibility to control whether the aggregate nominal amount of the Notes remains within the limits of the Programme.
