Common use of Agent as Lender Clause in Contracts

Agent as Lender. With respect to those portions of the Facility made available by it as a Lender, the Agent shall have the same rights and powers under the Facility Documents as any other Lender and may exercise the same as though it were not the Agent. The Agent and its Affiliates may accept deposits from, lend money to and generally engage in any kind of business with each Credit Party and its Affiliates and Persons doing business with such Credit Party and/or any of its Affiliates as if it were not the Agent and without any obligation to account to the Lenders therefor.

Agent as Lender. With respect to those portions of the Credit Facility made available by it as a Lenderit, the Agent shall have the same rights and powers under the Facility Documents hereunder as any other Lender and may exercise the same as though it were not the Agent. The Agent and its Affiliates affiliates may accept deposits from, lend money to and generally engage in any kind of business with each Credit Party the Borrower and its Affiliates affiliates and Persons persons doing business with such Credit Party the Borrower and/or any of its Affiliates affiliates as if it were not the Agent and without any obligation to account to the Lenders therefor.

The Agent and its Affiliates affiliates may accept deposits from, lend money to, act as agent for any Persons lending money to and generally engage in any kind of business with each Credit Party any Borrower and its Affiliates affiliates and Persons doing business with such Credit Party and/or any Borrower and any of its Affiliates affiliates as if it were not the Agent Agent, and without any obligation to account to the Lenders therefortherefor and the Agent may exercise its rights and powers with respect thereto as though it were not the Agent.
