Common use of Agent as Lender Clause in Contracts

Agent as Lender. With respect to that portion of the Term Loan and the Revolving Credit Facility made available by it, the Agent shall have the same rights and powers hereunder as any other Lender and may exercise the same as though it were not the Agent, and the term "Lender" or "Lenders" shall include the Agent in its capacity as a Lender. The Agent and its affiliates may accept deposits from, lend money to and generally engage in any kind of business with, the Security Parties as if it were not the Agent.

Agent as Lender. With respect to that portion of the Term Loan and the Revolving Credit Facility made available by itThe Agent shall, the Agent shall in its individual capacity, have the same rights and powers hereunder as any other Lender and may exercise the same as though it were not the Agent, and an agent; the term "Lender" or "Lenders" shall include the Agent in its individual capacity as a Lenderto the extent of its Percentage Interest. The Agent and its affiliates Subsidiaries and Affiliates may accept deposits from, lend money to to, and generally engage in any kind of banking, trust or other business withwith the Borrower and its Subsidiaries and Affiliates, the Security Parties as if it were not the Agent.

Agent as Lender. With respect to that portion those portions of the Term Loan and the Revolving Credit Facility Facilities made available by it, the Agent shall have the same rights and powers hereunder as any other Lender and may exercise the same as though it were not the Agent, and the term "Lender" or "Lenders" shall include the Agent in its capacity as a Lender. The Agent and its affiliates may accept deposits from, lend money to and generally engage in any kind of business with, with the Security Parties Borrowers and their affiliates and persons doing business with the Borrowers and/or any of their affiliates as if it were not the AgentAgent and without any obligation to account to the Lenders therefor.

With respect to that portion those portions of the Term Loan and the Revolving Credit Facility made available by it, the Agent shall have the same rights and powers hereunder under the Loan Documents as any other Lender and may exercise the same as though it were not the Agent, and the term "Lender" or "Lenders" shall include the Agent in its capacity as a Lender. The Agent and its affiliates Affiliates may accept deposits from, lend money to and generally engage in any kind of business with, with the Security Parties Borrower and its Affiliates and Persons doing business with the Borrower and/or any of its Affiliates as if it were not the AgentAgent and without any obligation to account to the Lenders therefor.

The Agent and its affiliates may accept deposits from, lend money to and generally engage in any kind of business with, the Borrower and the other Security Parties as if it were not the Agent.
