Common use of Agent as Lender Clause in Contracts

Agent as Lender. With respect to those portions of the Credit Facility made available by it, the Agent shall have the same rights and powers under the Loan Documents as any other Lender and may exercise the same as though it were not the Agent. The Agent and its Affiliates may accept deposits from, lend money to and generally engage in any kind of business with the Borrower and its Affiliates and Persons doing business with the Borrower and/or any of its Affiliates as if it were not the Agent and without any obligation to account to the Lenders therefor.

Agent as Lender. With respect to those portions of the Credit Facility Facilities made available by it, the Agent shall have the same rights and powers under the Loan Documents hereunder as any other Lender and may exercise the same as though it were not the Agent. The Agent and its Affiliates affiliates may accept deposits from, lend money to and generally engage in any kind of business with the Borrower Borrowers and its Affiliates their affiliates and Persons persons doing business with the Borrower Borrowers and/or any of its Affiliates their affiliates as if it were not the Agent and without any obligation to account to the Lenders therefor.

With respect to those portions that portion of the Term Loan and the Revolving Credit Facility made available by it, the Agent shall have the same rights and powers under the Loan Documents hereunder as any other Lender and may exercise the same as though it were not the Agent, and the term "Lender" or "Lenders" shall include the Agent in its capacity as a Lender. The Agent and its Affiliates affiliates may accept deposits from, lend money to and generally engage in any kind of business with with, the Borrower and its Affiliates and Persons doing business with the Borrower and/or any of its Affiliates Security Parties as if it were not the Agent and without any obligation to account to the Lenders thereforAgent.

The Agent and its Affiliates affiliates may accept deposits from, lend money to, act as agent for any Persons lending money to and generally engage in any kind of business with the any Borrower and its Affiliates affiliates and Persons doing business with the any Borrower and/or and any of its Affiliates affiliates as if it were not the Agent Agent, and without any obligation to account to the Lenders therefortherefor and the Agent may exercise its rights and powers with respect thereto as though it were not the Agent.
