Common use of Agent as a Lender Clause in Contracts

Agent as a Lender. With respect to Agent's ownership interest in the Loan and the Loan Documents as a Lender, Agent in its capacity as a Lender shall have the rights and powers of a Lender under this Agreement and the other Loan Documents as set forth herein and therein and may exercise the same as though it were not Agent.

Agent as a Lender. The Agent may make loans to, and generally engage in any kind of business with the Companies as though the Agent were not the Agent hereunder. With respect to Agent's ownership interest in the Loan and the Loan Documents its loans made or renewed by it or loan obligations hereunder as a Lender, the Agent in its capacity as a Lender shall have the same rights and powers of a Lender powers, duties and liabilities under this Financing Agreement and the other Loan Documents as set forth herein and therein any Lender and may exercise the same as though it were was not Agentthe Agent and the terms "Lender" and "Lenders" shall include the Agent in its individual capacity.
