Administrative Penalty Clause Samples

Administrative Penalty. In consideration of the penalty factors of CWA Section 309(g), 33 U.S.C. § 1319(g, Respondent shall pay to the United States a civil administrative penalty in the amount of $25,000 within thirty (30) calendar days of the Effective Date, as defined in Section X below, of this CA/FO.

Administrative Penalty. That PHH shall pay an administrative penalty of eight million, eight hundred and twenty-three thousand, five hundred and fifteen dollars ($8,823,515). Each Participating State will receive a payment of one hundred and fifty nine thousand, nine hundred and sixty seven dollars ($159,967), with each Participating State that also took part in an examination (Arizona, Georgia, Louisiana, and Massachusetts) receiving an additional one hundred and sixty five thousand, thirty three dollars ($165,033). PHH shall pay this administrative penalty by the means designated by each Participating State within fifteen (15) calendar days following the Effective Date of this Agreement.

Administrative Penalty. That Nationstar shall pay an Administrative Penalty of Seven Hundred And Fifty Thousand Dollars ($750,000) to be distributed equally among each Participating State (each Participating State will receive payment of $14,705.88) (the “per-state payment”). Nationstar shall pay the total Administrative Penalty amount within ten (10) calendar days following the Effective Date of this Agreement, by paying each Participating State the per-state payment by the means designated by each State. To the extent that Nationstar does not pay out the total Administrative Penalty within ten (10) calendar days of the Effective Date of this Agreement, then Nationstar shall deposit into the Qualified Settlement Fund Distribution Account within five (5) calendar days thereafter, for the benefit of each Participating State that has not been paid, that state’s portion of the Administrative Penalty, which amounts shall be for further administration by the Settlement Administrator.

Administrative Penalty. That New Day shall pay an administrative penalty of five million one hundred and sixty thousand dollars ($5,160,000.00) to be divided equally among the State Mortgage Regulators.

Administrative Penalty. The Secretary of State may assess a civil penalty against an athlete agent not to exceed Twenty- five Thousand Dollars ($25,000.00) for a violation of this chapter.

Administrative Penalty. That Respondents shall pay an Administrative Penalty Nineteen Million, Six Hundred Twenty-nine Thousand, Four Hundred Dollars ($19,629,400) to be prorated among each Participating State as designated in “Appendix A” attached to this Agreement (the “per-state payment”). Respondents shall pay the total Administrative Penalty amount within twenty (20) calendar days following the receipt of payment instructions, by paying each Participating State the per-state payment by the means designated by each State.

Administrative Penalty. That ACI shall pay an Administrative Penalty of $9,509,999.84 to be distributed equally among each Participating State (each Participating State will receive payment of $216,136.36 (the “per-state payment”)). ACI shall pay the total Administrative Penalty amount within twenty (20) calendar days following the receipt of payment instructions, by paying each Participating State the per-state payment by the means designated by each State.

Administrative Penalty. The Department may 15 assess a civil penalty against an athlete agent not to exceed 16 $5,000 for a violation of this Act. 17 Section 18. Uniformity of application and construction. 18 In applying and construing this Uniform Act, consideration 19 must be given to the need to promote uniformity of the law 20 with respect to its subject matter among States that enact 21 it.

Administrative Penalty. Block shall pay an Administrative Penalty of seventy-nine million and seventy-five thousand dollars ($79,075,000) to be distributed equally among the Participating States listed in “Appendix B” attached to this Agreement (the “per-state payment”). Block shall pay the total Administrative Penalty amount within twenty (20) calendar days following the receipt of payment instructions, by paying each Participating State listed in “Appendix B” attached to this Agreement the per-state payment by the means designated by each State.
