Common use of Admin Fees Clause in Contracts

Admin Fees. 5.5.1 If, in any rolling three (3) Month period, two (2) or more MI Failures occur, the Supplier acknowledges and agrees that the Authority shall have the right to invoice the Supplier Admin Fees and (subject to paragraph 5.5.2 below) in respect of any MI Failures as they arise in subsequent Months. 5.5.2 If, following activation of the Authority's right to charge Admin Fee(s) in respect of MI Failures pursuant to paragraph 5.5.1, the Supplier submits the Monthly MI Report for two (2) consecutive Months and no MI Failure occurs then the right to charge the Admin Fee(s) shall lapse. For the avoidance of doubt the Authority shall not be prevented from exercising such right again during the Term if the conditions in paragraph 5.5.1 are met. 5.5.3 The Supplier acknowledges and agrees that the Admin Fees are a fair reflection of the additional costs incurred by the Authority as a result of the Supplier failing to supply Management Information as required by this Framework Agreement. 5.5.4 The Authority shall notify the Supplier if any Admin Fees arise pursuant to paragraph 5.5.1 above and shall be entitled to invoice the Supplier for such Admin Fees which shall be payable in accordance with Clause 16 as a supplement to the Management Charge. Any exercise by the Authority of its rights under this paragraph shall be without prejudice to any other rights that may arise pursuant to the terms of the Framework Agreement.

Any exercise by the Authority of its rights under this paragraph shall be without prejudice to any other rights that may arise pursuant to the terms of the Framework Agreement.

The Authority shall notify the Supplier Service Provider if any Admin Fees arise pursuant to paragraph 5.5.1 above and shall be entitled to invoice the Supplier Service Provider for such Admin Fees which shall be payable in accordance with Clause 16 as a supplement to the Management Charge. Any exercise by the Authority of its rights under this paragraph shall be without prejudice to any other rights that may arise pursuant to the terms of the Framework Agreement.

Admin Fees. 5.5.1 If, in any rolling three (3) Month period, two (2) or more MI Failures occur, the Supplier Provider acknowledges and agrees that the Authority shall HSE shall, subject to paragraph 2.5.5, have the right to invoice receive the Supplier Admin Fees and (subject to paragraph 5.5.2 below) from the Provider’s Gain Share Fund in respect of any MI Failures as they arise in subsequent Months. 5.5.2 . If, following activation of the Authority's HSE’s right to charge Admin Fee(s) in respect of MI Failures pursuant to paragraph 5.5.12.5.4, the Supplier Provider submits the Monthly MI Report for two (2) consecutive Months and no MI Failure occurs then the right to charge the Admin Fee(s) shall lapse. For the avoidance of doubt the Authority HSE shall not be prevented from exercising such right again during the Term if the conditions in paragraph 5.5.1 2.5.4 are met. 5.5.3 . The Supplier Provider acknowledges and agrees that the Admin Fees are a fair reflection of the additional costs incurred by the Authority HSE as a result of the Supplier Provider failing to supply Management Information as required by this Framework Agreement. 5.5.4 The Authority . HSE shall notify the Supplier Provider if any Admin Fees arise pursuant to paragraph 5.5.1 above and shall be entitled to invoice the Supplier for such Admin Fees which shall be payable in accordance with Clause 16 as a supplement to the Management Charge2.5.4 above. Any exercise by the Authority HSE of its rights under this paragraph 2.5 shall be without prejudice to any other rights that may arise pursuant to the terms of the Framework this Agreement.

The Supplier acknowledges and agrees that the Admin Fees are a fair reflection of the additional costs incurred by the Authority as a result of the Supplier failing to supply Management Information as required by this Framework Commercial Agreement. 5.5.4 . The Authority shall notify the Supplier if any Admin Fees arise pursuant to paragraph 5.5.1 5.4 above and shall be entitled to invoice the Supplier for such Admin Fees which shall be payable in accordance with Clause 16 A12 of the Commercial Agreement as a supplement to the Management Charge. Any exercise by the Authority of its rights under this paragraph 5.7 shall be without prejudice to any other rights that may arise pursuant to the terms of the Framework this Commercial Agreement.

The Supplier acknowledges and agrees that the Admin Fees are a fair reflection of the additional costs incurred by the Authority as a result of the Supplier failing to supply Management Information as required by this Framework Agreement. 5.5.4 The . Authority shall notify the Supplier if any Admin Fees arise pursuant to paragraph 5.5.1 S9.1.1 above and shall be entitled to invoice the Supplier for such Admin Fees which shall be payable in accordance with Clause 16 Error: Reference source not found as a supplement to the Management Charge. Any exercise by the Authority of its rights under this paragraph shall be without prejudice to any other rights that may arise pursuant to the terms of the Framework Agreement.
