Common use of Admin Fees Clause in Contracts

Admin Fees. If, in any rolling three (3) Month period, two (2) or more MI Failures occur, the Supplier acknowledges and agrees that the Authority shall have the right to invoice the Supplier Admin Fees and (subject to paragraph 5.5.2) in respect of any MI Failures as they arise in subsequent Months. If, following activation of the Authority's right to charge Admin Fee(s) in respect of MI Failures pursuant to paragraph 5.5.1, the Supplier submits the Monthly MI Report for two (2) consecutive Months and no MI Failure occurs then the right to charge the Admin Fee(s) shall lapse. For the avoidance of doubt the Authority shall not be prevented from exercising such right again during the Term if the conditions in paragraph 5.5.1 are met. The Supplier acknowledges and agrees that the Admin Fees are a fair reflection of the additional costs incurred by the Authority as a result of the Supplier failing to supply Management Information as required by this Framework Agreement. The Authority shall notify the Supplier if any Admin Fees arise pursuant to paragraph 5.5.1 above and shall be entitled to invoice the Supplier for such Admin Fees which shall be payable in accordance with Clause 16 as a supplement to the Management Charge. Any exercise by the Authority of its rights under this paragraph shall be without prejudice to any other rights that may arise pursuant to the terms of the Framework Agreement.

For the avoidance of doubt the Authority shall not be prevented from exercising such right again during the Term if the conditions in paragraph 5.5.1 are met. The Supplier Service Provider acknowledges and agrees that the Admin Fees are a fair reflection of the additional costs incurred by the Authority as a result of the Supplier Service Provider failing to supply Management Information as required by this Framework Agreement. The Authority shall notify the Supplier Service Provider if any Admin Fees arise pursuant to paragraph 5.5.1 above and shall be entitled to invoice the Supplier Service Provider for such Admin Fees which shall be payable in accordance with Clause 16 as a supplement to the Management Charge. Any exercise by the Authority of its rights under this paragraph shall be without prejudice to any other rights that may arise pursuant to the terms of the Framework Agreement.

Admin Fees. The Supplier acknowledges and agrees that the Admin Fees are a fair reflection of the additional costs incurred by the Authority as a result of the Supplier failing to supply Management Information as required by this Framework Panel Agreement. The Authority shall notify the Supplier if any Admin Fees arise pursuant to paragraph 5.5.1 20.4 above and shall be entitled to invoice the Supplier for such Admin Fees which shall be payable in accordance with Clause 16 20 (Management Charge) as a supplement to the Management Charge. Any exercise by the Authority of its rights under this paragraph 5.7 shall be without prejudice to any other rights that may arise pursuant to the terms of the Framework this Panel Agreement.

Admin Fees. Any exercise by the Authority of its rights under this paragraph 5.7 shall be without prejudice to any other rights that may arise pursuant to the terms of the this Framework Agreement.

For the avoidance of doubt the Authority shall not be prevented from exercising such right again during the Term Framework Period if the conditions in paragraph 5.5.1 77.4 are met. The Supplier acknowledges and agrees that the Admin Fees are a fair reflection of the additional costs incurred by the Authority as a result of the Supplier failing to supply Management Information as required by this Framework Agreement. The Authority shall notify the Supplier if any Admin Fees arise pursuant to paragraph 5.5.1 77.4 above and shall be entitled to invoice the Supplier for such Admin Fees which shall be payable in accordance with Clause 16 20 (Management Charge) as a supplement to the Management Charge. Any exercise by the Authority of its rights under this paragraph 5.7 shall be without prejudice to any other rights that may arise pursuant to the terms of the this Framework Agreement.

The Authority shall notify the Supplier if any Admin Fees arise pursuant to paragraph 5.5.1 5.4 above and shall be entitled to invoice the Supplier for such Admin Fees which shall be payable in accordance with Clause 16 20 (Management Charge) as a supplement to the Management Charge. Any exercise by the Authority of its rights under this paragraph 5.7 shall be without prejudice to any other rights that may arise pursuant to the terms of the this Framework Agreement.

For the avoidance of doubt the Authority shall not be prevented from exercising such right again during the Term Framework Period if the conditions in paragraph 5.5.1 97.4 are met. The Supplier acknowledges and agrees that the Admin Fees are a fair reflection of the additional costs incurred by the Authority as a result of the Supplier failing to supply Management Information as required by this Framework Agreement. The Authority shall notify the Supplier if any Admin Fees arise pursuant to paragraph 5.5.1 97.4 above and shall be entitled to invoice the Supplier for such Admin Fees which shall be payable in accordance with Clause 16 19 (Management Charge) as a supplement to the Management Charge. Any exercise by the Authority of its rights under this paragraph 5.7 shall be without prejudice to any other rights that may arise pursuant to the terms of the this Framework Agreement.

Any exercise by the Authority of its rights under this paragraph 5.7 shall be without prejudice to any other rights that may arise pursuant to the terms of the this Framework Agreement.

Any exercise by the Authority of its rights under this paragraph 5.7 shall be without prejudice to any other rights that may arise pursuant to the terms of the this Framework Agreement.

The Authority shall notify the Supplier if any Admin Fees arise pursuant to paragraph 5.5.1 1.22 above and shall be entitled to invoice the Supplier for such Admin Fees which shall be payable in accordance with Clause clause 16 as a supplement to the Management Charge. Any exercise by the Authority of its rights under this paragraph shall be without prejudice to any other rights that may arise pursuant to the terms of the Framework Agreement.

The Supplier acknowledges and agrees that the Admin Fees are a fair reflection of the additional costs incurred by the Authority as a result of the Supplier failing to supply Management Information as required by this Framework Agreement. The Authority shall notify the Supplier if any Admin Fees arise pursuant to paragraph 5.5.1 200 above and shall be entitled to invoice the Supplier for such Admin Fees which shall be payable in accordance with Clause 16 51 (Management Charge) as a supplement to the Management Charge. Any exercise by the Authority of its rights under this paragraph 5.7 shall be without prejudice to any other rights that may arise pursuant to the terms of the this Framework Agreement.

Admin Fees. For the avoidance of doubt the Authority shall not be prevented from exercising such right again during the Term Framework Period if the conditions in paragraph 5.5.1 82.4 are met. The Supplier acknowledges and agrees that the Admin Fees are a fair reflection of the additional costs incurred by the Authority as a result of the Supplier failing to supply Management Information as required by this Framework Agreement. The Authority shall notify the Supplier if any Admin Fees arise pursuant to paragraph 5.5.1 82.4 above and shall be entitled to invoice the Supplier for such Admin Fees which shall be payable in accordance with Clause 16 20 (Management Charge) as a supplement to the Management Charge. Any exercise by the Authority of its rights under this paragraph 5.7 shall be without prejudice to any other rights that may arise pursuant to the terms of the this Framework Agreement.

Admin Fees. If, in any rolling three (3) Month period, two (2) or more MI Failures occur, the Supplier acknowledges and agrees that the Authority shall have the right to invoice the Supplier Admin Fees and (subject to paragraph 5.5.216.5.2) in respect of any MI Failures as they arise in subsequent Months. If, following activation of the Authority's right to charge Admin Fee(s) in respect of MI Failures pursuant to paragraph 5.5.116.5.1, the Supplier submits the Monthly MI Report for two (2) consecutive Months and no MI Failure occurs then the right to charge the Admin Fee(s) shall lapse. For the avoidance of doubt the Authority shall not be prevented from exercising such right again during the Term Framework Period if the conditions in paragraph 5.5.1 16.5.1 are met. The Supplier acknowledges and agrees that the Admin Fees are a fair reflection of the additional costs incurred by the Authority as a result of the Supplier failing to supply Management Information as required by this Framework Agreement. The Authority shall notify the Supplier if any Admin Fees arise pursuant to paragraph 5.5.1 16.4 above and shall be entitled to invoice the Supplier for such Admin Fees which shall be payable in accordance with Clause 16 as a supplement to the Management ChargeCharge or Default Management Charge as applicable. Any exercise by the Authority of its rights under this paragraph shall be without prejudice to any other rights that may arise pursuant to the terms of the Framework Agreement.

Admin Fees. If, in any rolling three (3) Month period, two (2) or more MI Failures occur, the Supplier acknowledges and agrees that the Authority shall have the right to invoice the Supplier Admin Fees and (subject to paragraph 5.5.25.6) in respect of any MI Failures as they arise in subsequent Months. If, following activation of the Authority's right to charge Admin Fee(s) in respect of MI Failures pursuant to paragraph 5.5.15.5, the Supplier submits the Monthly MI Report for two (2) consecutive Months and no MI Failure occurs then the right to charge the Admin Fee(s) shall lapse. For the avoidance of doubt the Authority shall not be prevented from exercising such right again during the Term if the conditions in paragraph 5.5.1 5.5 are met. The Supplier acknowledges and agrees that the Admin Fees are a fair reflection of the additional costs incurred by the Authority as a result of the Supplier failing to supply Management Information as required by this Framework Agreement. The Authority shall notify the Supplier if any Admin Fees arise pursuant to paragraph 5.5.1 5.5 above and shall be entitled to invoice the Supplier for such Admin Fees which shall be payable in accordance with Clause 16 14 as a supplement to the Management Charge. Any exercise by the Authority of its rights under this paragraph shall be without prejudice to any other rights that may arise pursuant to the terms of the Framework Agreement.

Admin Fees. If, in any rolling three (3) Month period, two (2) or more MI Failures occur, the Supplier acknowledges and agrees that the Authority shall have the right to invoice the Supplier Admin Fees and (subject to paragraph 5.5.2) in respect of any MI Failures as they arise in subsequent Months. If, following activation of the Authority's right to charge Admin Fee(s) in respect of MI Failures pursuant to paragraph 5.5.1, the Supplier submits the Monthly MI Report for two (2) consecutive Months and no MI Failure occurs then the right to charge the Admin Fee(s) shall lapse. For the avoidance of doubt the Authority shall not be prevented from exercising such right again during the Term if the conditions in paragraph 5.5.1 are met. The Supplier acknowledges and agrees that the Admin Fees are a fair reflection of the additional costs incurred by the Authority as a result of the Supplier failing to supply Management Information as required by this Framework Agreement. The Authority shall notify the Supplier if any Admin Fees arise pursuant to paragraph 5.5.1 above and shall be entitled to invoice the Supplier for such Admin Fees which shall be payable in accordance with Clause 16 as a supplement to the Management Charge. Any exercise by the Authority of its rights under this paragraph shall be without prejudice to any other rights that may arise pursuant to the terms of the Framework Agreement.

If, following activation of the Authority's right to charge Admin Fee(s) in respect of MI Failures pursuant to paragraph 5.5.177.4, the Supplier submits the Monthly MI Report for two (2) consecutive Months and no MI Failure occurs then the right to charge the Admin Fee(s) shall lapse. For the avoidance of doubt the Authority shall not be prevented from exercising such right again during the Term Framework Period if the conditions in paragraph 5.5.1 77.4 are met. The Supplier acknowledges and agrees that the Admin Fees are a fair reflection of the additional costs incurred by the Authority as a result of the Supplier failing to supply Management Information as required by this Framework Agreement. The Authority shall notify the Supplier if any Admin Fees arise pursuant to paragraph 5.5.1 77.4 above and shall be entitled to invoice the Supplier for such Admin Fees which shall be payable in accordance with Clause 16 17 (Management Charge) as a supplement to the Management Charge. Any exercise by the Authority of its rights under this paragraph 5.7 shall be without prejudice to any other rights that may arise pursuant to the terms of the this Framework Agreement.

Admin Fees. If, in any rolling three (3) Month period, two (2) or more MI Failures occur, the Supplier acknowledges and agrees that the Authority CCS shall have the right to invoice the Supplier Admin Fees and (subject to paragraph 5.5.25.5) in respect of any MI Failures as they arise in subsequent Months. If, following activation of the AuthorityCCS's right to charge Admin Fee(s) in respect of MI Failures pursuant to paragraph 5.5.15.4, the Supplier submits the Monthly MI Report for two (2) consecutive Months and no MI Failure occurs then the right to charge the Admin Fee(s) shall lapse. For the avoidance of doubt the Authority CCS shall not be prevented from exercising such right again during the Term Framework Period if the conditions in paragraph 5.5.1 5.4 are met. The Supplier acknowledges and agrees that the Admin Fees are a fair reflection of the additional costs incurred by the Authority CCS as a result of the Supplier failing to supply Management Information as required by this Framework Agreement. The Authority CCS shall notify the Supplier if any Admin Fees arise pursuant to paragraph 5.5.1 5.4 above and shall be entitled to invoice the Supplier for such Admin Fees which shall be payable in accordance with Clause 16 13 (Management Charge) as a supplement to the Management Charge. Any exercise by the Authority CCS of its rights under this paragraph 5.7 shall be without prejudice to any other rights that may arise pursuant to the terms of the this Framework Agreement.

Admin Fees. If, in any rolling three (3) Month period, two (2) or more MI Failures occur, the Supplier acknowledges and agrees that the Authority shall have the right to invoice the Supplier Admin Fees and (subject to paragraph 5.5.25.7) in respect of any MI Failures as they arise in subsequent Months. If, following activation of the Authority's ’s right to charge Admin Fee(s) in respect of MI Failures pursuant to paragraph 5.5.15.6, the Supplier submits the Monthly MI Report for two (2) consecutive Months and no MI Failure occurs then the right to charge the Admin Fee(s) shall lapse. For the avoidance of doubt the Authority shall not be prevented from exercising such right again during the Term if the conditions in paragraph 5.5.1 5.6 are met. The Supplier acknowledges and agrees that the Admin Fees are a fair reflection of the additional costs incurred by the Authority as a result of the Supplier failing to supply Management Information as required by this Framework Agreement. The Authority shall notify the Supplier if any Admin Fees arise pursuant to paragraph 5.5.1 5.6 above and shall be entitled to invoice the Supplier for such Admin Fees which shall be payable in accordance with Clause clause 16 as a supplement to the Management Charge. Any exercise by the Authority of its rights under this paragraph shall be without prejudice to any other rights that may arise pursuant to the terms of the Framework Agreement.

Admin Fees. If, in any rolling three (3) Month period, two (2) or more MI Failures occur, the Supplier acknowledges and agrees that the Authority shall have the right to invoice the Supplier Admin Fees and (subject to paragraph 5.5.228.5.2) in respect of any MI Failures as they arise in subsequent Months. If, following activation of the Authority's right to charge Admin Fee(s) in respect of MI Failures pursuant to paragraph 5.5.128.5.1, the Supplier submits the Monthly MI Report for two (2) consecutive Months and no MI Failure occurs then the right to charge the Admin Fee(s) shall lapse. For the avoidance of doubt the Authority shall not be prevented from exercising such right again during the Term Framework Period if the conditions in paragraph 5.5.1 28.5.1 are met. The Supplier acknowledges and agrees that the Admin Fees are a fair reflection of the additional costs incurred by the Authority as a result of the Supplier failing to supply Management Information as required by this Framework Agreement. The Authority shall notify the Supplier if any Admin Fees arise pursuant to paragraph 5.5.1 28.4 above and shall be entitled to invoice the Supplier for such Admin Fees which shall be payable in accordance with Clause 16 40 as a supplement to the Management ChargeCharges or Default Management Charge as applicable. Any exercise by the Authority of its rights under this paragraph shall be without prejudice to any other rights that may arise pursuant to the terms of the Framework Agreement.

Admin Fees. If, in any rolling three (3) Month period, two (2) or more MI Failures occur, the Supplier acknowledges and agrees that the Authority shall have the right to invoice the Supplier Admin Fees and (subject to paragraph 5.5.276.5) in respect of any MI Failures as they arise in subsequent Months. If, following activation of the Authority's right to charge Admin Fee(s) in respect of MI Failures pursuant to paragraph 5.5.176.4, the Supplier submits the Monthly MI Report for two (2) consecutive Months and no MI Failure occurs then the right to charge the Admin Fee(s) shall lapse. For the avoidance of doubt the Authority shall not be prevented from exercising such right again during the Term Framework Period if the conditions in paragraph 5.5.1 76.4 are met. The Supplier acknowledges and agrees that the Admin Fees are a fair reflection of the additional costs incurred by the Authority as a result of the Supplier failing to supply Management Information as required by this Framework Agreement. The Authority shall notify the Supplier if any Admin Fees arise pursuant to paragraph 5.5.1 76.4 above and shall be entitled to invoice the Supplier for such Admin Fees which shall be payable in accordance with Clause 16 17 (Management Charge) as a supplement to the Management Charge. Any exercise by the Authority of its rights under this paragraph 5.7 shall be without prejudice to any other rights that may arise pursuant to the terms of the this Framework Agreement.

Admin Fees. If, in any rolling three (3) Month period, two (2) or more MI Failures occur, the Supplier acknowledges and agrees that the Authority shall have the right to invoice the Supplier Admin Fees and (subject to paragraph 5.5.279.5) in respect of any MI Failures as they arise in subsequent Months. If, following activation of the Authority's right to charge Admin Fee(s) in respect of MI Failures pursuant to paragraph 5.5.179.4, the Supplier submits the Monthly MI Report for two (2) consecutive Months and no MI Failure occurs then the right to charge the Admin Fee(s) shall lapse. For the avoidance of doubt the Authority shall not be prevented from exercising such right again during the Term Framework Period if the conditions in paragraph 5.5.1 79.4 are met. The Supplier acknowledges and agrees that the Admin Fees are a fair reflection of the additional costs incurred by the Authority as a result of the Supplier failing to supply Management Information as required by this Framework Agreement. The Authority shall notify the Supplier if any Admin Fees arise pursuant to paragraph 5.5.1 79.4 above and shall be entitled to invoice the Supplier for such Admin Fees which shall be payable in accordance with Clause 16 20 (Management Charge) as a supplement to the Management Charge. Any exercise by the Authority of its rights under this paragraph 5.7 shall be without prejudice to any other rights that may arise pursuant to the terms of the this Framework Agreement.

Admin Fees. If, in any rolling three (3) Month period, two (2) or more MI Failures occur, the Supplier acknowledges and agrees that the Authority shall have the right to invoice the Supplier Admin Fees and (subject to paragraph 5.5.230.5.2) in respect of any MI Failures as they arise in subsequent Months. If, following activation of the Authority's right to charge Admin Fee(s) in respect of MI Failures pursuant to paragraph 5.5.130.5.1, the Supplier submits the Monthly MI Report for two (2) consecutive Months and no MI Failure occurs then the right to charge the Admin Fee(s) shall lapse. For the avoidance of doubt the Authority shall not be prevented from exercising such right again during the Term Framework Period if the conditions in paragraph 5.5.1 30.5.1 are met. The Supplier acknowledges and agrees that the Admin Fees are a fair reflection of the additional costs incurred by the Authority as a result of the Supplier failing to supply Management Information as required by this Framework Agreement. The Authority shall notify the Supplier if any Admin Fees arise pursuant to paragraph 5.5.1 30.5.1 above and shall be entitled to invoice the Supplier for such Admin Fees which shall be payable in accordance with Clause 16 15 as a supplement to the Management Charge. Any exercise by the Authority of its rights under this paragraph shall be without prejudice to any other rights that may arise pursuant to the terms of the Framework Agreement.

Admin Fees. If, in any rolling three (3) Month period, two (2) or more MI Failures occur, the Supplier acknowledges and agrees that the Authority shall have the right to invoice the Supplier Admin Fees and (subject to paragraph 5.5.287.5) in respect of any MI Failures as they arise in subsequent Months. If, following activation of the Authority's right to charge Admin Fee(s) in respect of MI Failures pursuant to paragraph 5.5.187.4, the Supplier submits the Monthly MI Report for two (2) consecutive Months and no MI Failure occurs then the right to charge the Admin Fee(s) shall lapse. For the avoidance of doubt the Authority shall not be prevented from exercising such right again during the Term Framework Period if the conditions in paragraph 5.5.1 87.4 are met. The Supplier acknowledges and agrees that the Admin Fees are a fair reflection of the additional costs incurred by the Authority as a result of the Supplier failing to supply Management Information as required by this Framework Agreement. The Authority shall notify the Supplier if any Admin Fees arise pursuant to paragraph 5.5.1 87.4 above and shall be entitled to invoice the Supplier for such Admin Fees which shall be payable in accordance with Clause 16 19 (Management Charge) as a supplement to the Management Charge. Any exercise by the Authority of its rights under this paragraph 5.7 shall be without prejudice to any other rights that may arise pursuant to the terms of the this Framework Agreement.

Admin Fees. If, in any rolling three (3) Month period, two (2) or more MI Failures occur, the Supplier acknowledges and agrees that the Authority shall have the right to invoice the Supplier Admin Fees and (subject to paragraph 5.5.2213) in respect of any MI Failures as they arise in subsequent Months. If, following activation of the Authority's right to charge Admin Fee(s) in respect of MI Failures pursuant to paragraph 5.5.1212, the Supplier submits the Monthly MI Report for two (2) consecutive Months and no MI Failure occurs then the right to charge the Admin Fee(s) shall lapse. For the avoidance of doubt the Authority shall not be prevented from exercising such right again during the Term Framework Period if the conditions in paragraph 5.5.1 212 are met. The Supplier acknowledges and agrees that the Admin Fees are a fair reflection of the additional costs incurred by the Authority as a result of the Supplier failing to supply Management Information as required by this Framework Agreement. The Authority shall notify the Supplier if any Admin Fees arise pursuant to paragraph 5.5.1 212 above and shall be entitled to invoice the Supplier for such Admin Fees which shall be payable in accordance with Clause 16 47 (Management Charge) as a supplement to the Management Charge. Any exercise by the Authority of its rights under this paragraph 5.7 shall be without prejudice to any other rights that may arise pursuant to the terms of the this Framework Agreement.

Admin Fees. If, in any rolling three (3) Month period, two (2) or more MI Failures occur, the Supplier acknowledges and agrees that the Authority CCS shall have the right to invoice the Supplier Admin Fees and (subject to paragraph 5.5.25.5) in respect of any MI Failures as they arise in subsequent Months. If, following activation of the AuthorityCCS's right to charge Admin Fee(s) in respect of MI Failures pursuant to paragraph 5.5.15.4, the Supplier submits the Monthly MI Report for two (2) consecutive Months and no MI Failure occurs then the right to charge the Admin Fee(s) shall lapse. For the avoidance of doubt the Authority CCS shall not be prevented from exercising such right again during the Term Framework Period if the conditions in paragraph 5.5.1 5.4 are met. The Supplier acknowledges and agrees that the Admin Fees are a fair reflection of the additional costs incurred by the Authority CCS as a result of the Supplier failing to supply Management Information as required by this Framework Agreement. The Authority CCS shall notify the Supplier if any Admin Fees arise pursuant to paragraph 5.5.1 5.4 above and shall be entitled to invoice the Supplier for such Admin Fees which shall be payable in accordance with Clause 16 20 (Management Charge) as a supplement to the Management Charge. Any exercise by the Authority CCS of its rights under this paragraph 5.7 shall be without prejudice to any other rights that may arise pursuant to the terms of the this Framework Agreement.

Admin Fees. Any exercise by the Authority of its rights under this paragraph shall be without prejudice to any other rights that may arise pursuant to the terms of the Framework Agreement.

If, in any rolling three (3) Month period, two (2) or more MI Failures occur, the Supplier acknowledges and agrees that the Authority shall have the right to invoice the Supplier Admin Fees and (subject to paragraph 5.5.281.5) in respect of any MI Failures as they arise in subsequent Months. If, following activation of the Authority's right to charge Admin Fee(s) in respect of MI Failures pursuant to paragraph 5.5.181.4, the Supplier submits the Monthly MI Report for two (2) consecutive Months and no MI Failure occurs then the right to charge the Admin Fee(s) shall lapse. For the avoidance of doubt the Authority shall not be prevented from exercising such right again during the Term Framework Period if the conditions in paragraph 5.5.1 81.4 are met. The Supplier acknowledges and agrees that the Admin Fees are a fair reflection of the additional costs incurred by the Authority as a result of the Supplier failing to supply Management Information as required by this Framework Agreement. The Authority shall notify the Supplier if any Admin Fees arise pursuant to paragraph 5.5.1 81.4 above and shall be entitled to invoice the Supplier for such Admin Fees which shall be payable in accordance with Clause 16 20 (Management Charge) as a supplement to the Management Charge. Any exercise by the Authority of its rights under this paragraph 5.7 shall be without prejudice to any other rights that may arise pursuant to the terms of the this Framework Agreement.

Admin Fees. If, in any rolling three (3) Month period, two (2) or more MI Failures occur, the Supplier acknowledges and agrees that the Authority shall have the right to invoice the Supplier Admin Fees and (subject to paragraph 5.5.27.6) in respect of any MI Failures as they arise in subsequent Months. If, following activation of the Authority's ’s right to charge Admin Fee(s) in respect of MI Failures pursuant to paragraph 5.5.17.5, the Supplier submits the Monthly MI Report for two (2) consecutive Months and no MI Failure occurs then the right to charge the Admin Fee(s) shall lapse. For the avoidance of doubt the Authority shall not be prevented from exercising such right again during the Term if the conditions in paragraph 5.5.1 7.5 are met. The Supplier acknowledges and agrees that the Admin Fees are a fair reflection of the additional costs incurred by the Authority as a result of the Supplier failing to supply Management Information as required by this Framework Agreement. The Authority shall notify the Supplier if any Admin Fees arise pursuant to paragraph 5.5.1 7.5 above and shall be entitled to invoice the Supplier for such Admin Fees which shall be payable in accordance with Clause clause 16 as a supplement to the Management Charge. Any exercise by the Authority of its rights under this paragraph shall be without prejudice to any other rights that may arise pursuant to the terms of the Framework Agreement.

Admin Fees. If, in any rolling three (3) Month period, two (2) or more MI Failures occur, the Supplier acknowledges and agrees that the Authority shall have the right to invoice the Supplier Admin Fees and (subject to paragraph 5.5.2S8.1.11) in respect of any MI Failures as they arise in subsequent Months. For the avoidance of doubt the Authority shall not be prevented from exercising such right again during the Term if the conditions in paragraph 5.5.1 S9.1.1 are met. The Supplier acknowledges and agrees that the Admin Fees are a fair reflection of the additional costs incurred by the Authority as a result of the Supplier failing to supply Management Information as required by this Framework Agreement. The Authority shall notify the Supplier if any Admin Fees arise pursuant to paragraph 5.5.1 S9.1.1 above and shall be entitled to invoice the Supplier for such Admin Fees which shall be payable in accordance with Clause 16 Error: Reference source not found as a supplement to the Management Charge. Any exercise by the Authority of its rights under this paragraph shall be without prejudice to any other rights that may arise pursuant to the terms of the Framework Agreement.

Admin Fees. If, in any rolling three (3) Month period, two (2) or more MI Failures occur, the Supplier acknowledges and agrees that the Authority shall have the right to invoice the Supplier Admin Fees and (subject to paragraph 5.5.280.5) in respect of any MI Failures as they arise in subsequent Months. If, following activation of the Authority's right to charge Admin Fee(s) in respect of MI Failures pursuant to paragraph 5.5.180.4, the Supplier submits the Monthly MI Report for two (2) consecutive Months and no MI Failure occurs then the right to charge the Admin Fee(s) shall lapse. For the avoidance of doubt the Authority shall not be prevented from exercising such right again during the Term Framework Period if the conditions in paragraph 5.5.1 80.4 are met. The Supplier acknowledges and agrees that the Admin Fees are a fair reflection of the additional costs incurred by the Authority as a result of the Supplier failing to supply Management Information as required by this Framework Agreement. The Authority shall notify the Supplier if any Admin Fees arise pursuant to paragraph 5.5.1 80.4 above and shall be entitled to invoice the Supplier for such Admin Fees which shall be payable in accordance with Clause 16 20 (Management Charge) as a supplement to the Management Charge. Any exercise by the Authority of its rights under this paragraph 5.7 shall be without prejudice to any other rights that may arise pursuant to the terms of the this Framework Agreement.

Admin Fees. If, in any rolling three (3) Month period, two (2) or more MI Failures occur, the Supplier acknowledges and agrees that the Authority shall have the right to invoice the Supplier Admin Fees and (subject to paragraph 5.5.283.5) in respect of any MI Failures as they arise in subsequent Months. If, following activation of the Authority's right to charge Admin Fee(s) in respect of MI Failures pursuant to paragraph 5.5.183.4, the Supplier submits the Monthly MI Report for two (2) consecutive Months and no MI Failure occurs then the right to charge the Admin Fee(s) shall lapse. For the avoidance of doubt the Authority shall not be prevented from exercising such right again during the Term Framework Period if the conditions in paragraph 5.5.1 83.4 are met. The Supplier acknowledges and agrees that the Admin Fees are a fair reflection of the additional costs incurred by the Authority as a result of the Supplier failing to supply Management Information as required by this Framework Agreement. The Authority shall notify the Supplier if any Admin Fees arise pursuant to paragraph 5.5.1 83.4 above and shall be entitled to invoice the Supplier for such Admin Fees which shall be payable in accordance with Clause 16 19 (Management Charge) as a supplement to the Management Charge. Any exercise by the Authority of its rights under this paragraph 5.7 shall be without prejudice to any other rights that may arise pursuant to the terms of the this Framework Agreement.

Admin Fees. If, in any rolling three (3) Month period, two (2) or more MI Failures occur, the Supplier acknowledges and agrees that the Authority shall have the right to invoice the Supplier Admin Fees and (subject to paragraph 5.5.230.5.2) in respect of any MI Failures as they arise in subsequent Months. If, following activation of the Authority's right to charge Admin Fee(s) in respect of MI Failures pursuant to paragraph 5.5.130.5.1, the Supplier submits the Monthly MI Report for two (2) consecutive Months and no MI Failure occurs then the right to charge the Admin Fee(s) shall lapse. For the avoidance of doubt the Authority shall not be prevented from exercising such right again during the Term Framework Period if the conditions in paragraph 5.5.1 30.5.1 are met. The Supplier acknowledges and agrees that the Admin Fees are a fair reflection of the additional costs incurred by the Authority as a result of the Supplier failing to supply Management Information as required by this Framework Agreement. The Authority shall notify the Supplier if any Admin Fees arise pursuant to paragraph 5.5.1 30.5.1 above and shall be entitled to invoice the Supplier for such Admin Fees which shall be payable in accordance with Clause 16 14. as a supplement to the Management Charge. Any exercise by the Authority of its rights under this paragraph shall be without prejudice to any other rights that may arise pursuant to the terms of the Framework Agreement.

Admin Fees. If, in any rolling three (3) Month period, two (2) or more MI Failures occur, the Supplier acknowledges and agrees that the Authority shall have the right to invoice the Supplier Admin Fees and (subject to paragraph 5.5.25.5) in respect of any MI Failures as they arise in subsequent Months. If, following activation of the Authority's right to charge Admin Fee(s) in respect of MI Failures pursuant to paragraph 5.5.15.4, the Supplier submits the Monthly MI Report for two (2) consecutive Months and no MI Failure occurs then the right to charge the Admin Fee(s) shall lapse. For the avoidance of doubt the Authority shall not be prevented from exercising such right again during the Term Framework Period if the conditions in paragraph 5.5.1 5.4 are met. The Supplier acknowledges and agrees that the Admin Fees are a fair reflection of the additional costs incurred by the Authority as a result of the Supplier failing to supply Management Information as required by this Framework Agreement. The Authority shall notify the Supplier if any Admin Fees arise pursuant to paragraph 5.5.1 5.4 above and shall be entitled to invoice the Supplier for such Admin Fees which shall be payable in accordance with Clause 16 19 (Management Charge) as a supplement to the Management Charge. Any exercise by the Authority of its rights under this paragraph 5.7 shall be without prejudice to any other rights that may arise pursuant to the terms of the this Framework Agreement.

Admin Fees. If, in any rolling three (3) Month period, two (2) or more MI Failures occur, the Supplier acknowledges and agrees that the Authority shall have the right to invoice the Supplier Admin Fees and (subject to paragraph 5.5.255) in respect of any MI Failures as they arise in subsequent Months. If, following activation of the Authority's right to charge Admin Fee(s) in respect of MI Failures pursuant to paragraph 5.5.154, the Supplier submits the Monthly MI Report for two (2) consecutive Months and no MI Failure occurs then the right to charge the Admin Fee(s) shall lapse. For the avoidance of doubt the Authority shall not be prevented from exercising such right again during the Term Framework Period if the conditions in paragraph 5.5.1 54 are met. The Supplier acknowledges and agrees that the Admin Fees are a fair reflection of the additional costs incurred by the Authority as a result of the Supplier failing to supply Management Information as required by this Framework Agreement. The Authority shall notify the Supplier if any Admin Fees arise pursuant to paragraph 5.5.1 54 above and shall be entitled to invoice the Supplier for such Admin Fees which shall be payable in accordance with Clause 16 37 (Management Charge) as a supplement to the Management Charge. Any exercise by the Authority of its rights under this paragraph 5.7 shall be without prejudice to any other rights that may arise pursuant to the terms of the this Framework Agreement.

Admin Fees. If, in any rolling three (3) Month period, two (2) or more MI Failures occur, the Supplier acknowledges and agrees that the Authority shall have the right to invoice the Supplier Admin Fees and (subject to paragraph 5.5.276.5) in respect of any MI Failures as they arise in subsequent Months. If, following activation of the Authority's right to charge Admin Fee(s) in respect of MI Failures pursuant to paragraph 5.5.176.4, the Supplier submits the Monthly MI Report for two (2) consecutive Months and no MI Failure occurs then the right to charge the Admin Fee(s) shall lapse. For the avoidance of doubt the Authority shall not be prevented from exercising such right again during the Term Framework Period if the conditions in paragraph 5.5.1 76.4 are met. The Supplier acknowledges and agrees that the Admin Fees are a fair reflection of the additional costs incurred by the Authority as a result of the Supplier failing to supply Management Information as required by this Framework Agreement. The Authority shall notify the Supplier if any Admin Fees arise pursuant to paragraph 5.5.1 76.4 above and shall be entitled to invoice the Supplier for such Admin Fees which shall be payable in accordance with Clause 16 19 (Management Charge) as a supplement to the Management Charge. Any exercise by the Authority of its rights under this paragraph 5.7 shall be without prejudice to any other rights that may arise pursuant to the terms of the this Framework Agreement.

If, following activation of the Authority's right to charge Admin Fee(s) in respect of MI Failures pursuant to paragraph 5.5.179.4, the Supplier submits the Monthly MI Report for two (2) consecutive Months and no MI Failure occurs then the right to charge the Admin Fee(s) shall lapse. For the avoidance of doubt the Authority shall not be prevented from exercising such right again during the Term Framework Period if the conditions in paragraph 5.5.1 79.4 are met. The Supplier acknowledges and agrees that the Admin Fees are a fair reflection of the additional costs incurred by the Authority as a result of the Supplier failing to supply Management Information as required by this Framework Agreement. The Authority shall notify the Supplier if any Admin Fees arise pursuant to paragraph 5.5.1 79.4 above and shall be entitled to invoice the Supplier for such Admin Fees which shall be payable in accordance with Clause 16 19 (Management Charge) as a supplement to the Management Charge. Any exercise by the Authority of its rights under this paragraph 5.7 shall be without prejudice to any other rights that may arise pursuant to the terms of the this Framework Agreement.

If, following activation of the Authority's right to charge Admin Fee(s) in respect of MI Failures pursuant to paragraph 5.5.15,4, the Supplier submits the Monthly MI Report for two (2) consecutive Months and no MI Failure occurs then the right to charge the Admin Fee(s) shall lapse. For the avoidance of doubt the Authority shall not be prevented from exercising such right again during the Term Framework Period if the conditions in paragraph 5.5.1 5.4 are met. The Supplier acknowledges and agrees that the Admin Fees are a fair reflection of the additional costs incurred by the Authority as a result of the Supplier failing to supply Management Information as required by this Framework Agreement. The Authority shall notify the Supplier if any Admin Fees arise pursuant to paragraph 5.5.1 72.4 above and shall be entitled to invoice the Supplier for such Admin Fees which shall be payable in accordance with Clause 16 18 (Management Charge) as a supplement to the Management Charge. Any exercise by the Authority of its rights under this paragraph 5.7 shall be without prejudice to any other rights that may arise pursuant to the terms of the this Framework Agreement.

Admin Fees. If, in any rolling three (3) Month period, two (2) or more MI Failures occur, the Supplier acknowledges and agrees that the Authority shall have the right to invoice the Supplier Admin Fees and (subject to paragraph 5.5.283.5) in respect of any MI Failures as they arise in subsequent Months. If, following activation of the Authority's right to charge Admin Fee(s) in respect of MI Failures pursuant to paragraph 5.5.183.4, the Supplier submits the Monthly MI Report for two (2) consecutive Months and no MI Failure occurs then the right to charge the Admin Fee(s) shall lapse. For the avoidance of doubt the Authority shall not be prevented from exercising such right again during the Term Framework Period if the conditions in paragraph 5.5.1 83.4 are met. The Supplier acknowledges and agrees that the Admin Fees are a fair reflection of the additional costs incurred by the Authority as a result of the Supplier failing to supply Management Information as required by this Framework Agreement. The Authority shall notify the Supplier if any Admin Fees arise pursuant to paragraph 5.5.1 83.4 above and shall be entitled to invoice the Supplier for such Admin Fees which shall be payable in accordance with Clause 16 20 (Management Charge) as a supplement to the Management Charge. Any exercise by the Authority of its rights under this paragraph 5.7 shall be without prejudice to any other rights that may arise pursuant to the terms of the this Framework Agreement.
