Common use of Additional Transferors Clause in Contracts

Additional Transferors. The Transferor may designate Affiliates of the Transferor to be included as Transferors (“Additional Transferors”) under this Agreement in an amendment hereto pursuant to subsection 9.01(a) and, in connection with such designation, the Transferor shall surrender the Transferor Certificate to the Owner Trustee in exchange for a newly issued Transferor Certificate modified to reflect such Additional Transferor’s interest in the Transferor Interest; provided, however, that prior to any such designation and exchange the conditions set forth in clauses (iii) and (v) of subsection 3.06(b) of the Trust Agreement shall have been satisfied with respect thereto.

The Transferor may designate Affiliates of the Transferor Commercial Credit Company to be included as Transferors (“"Additional Transferors”") under this Agreement in by an amendment hereto pursuant to subsection 9.01(a13.01(a) and, in connection with such designation, the Transferor shall surrender the Transferor Certificate to the Owner Trustee in exchange for a newly issued Transferor Certificate modified to reflect such Additional Transferor’s 's interest in the Transferor Transferor's Interest; provided, however, that prior to any such designation and exchange the conditions set forth in clauses (iiisubsection 6.03(c) and (v) of subsection 3.06(b) of the Trust Agreement or 6.03(d), as applicable, shall have been satisfied with respect thereto.
