Additional Plants Sample Clauses
The "Additional Plants" clause defines the terms under which new manufacturing or production facilities may be added to an existing agreement. Typically, this clause outlines the process for notifying the other party, obtaining necessary approvals, and integrating the new plant into the contractual framework, such as extending supply obligations or quality standards to the new location. Its core function is to provide a clear mechanism for expanding operations while ensuring both parties understand their rights and responsibilities regarding any additional facilities, thereby preventing disputes and maintaining operational consistency.
Additional Plants. In addition to the Initial Plant, the BioAmber Parties and Mitsui intend to build and operate two (2) additional plants to produce and sell BSA and BDO using the BioAmber Technology (collectively, the “Additional Plants”), as follows:
Additional Plants. As to electricity or other energy generated by all additional plants built on the leased land or, if applicable, the Adjacent Lease from geothermal resources therein, other than the Existing Plant or the New Plants (the "Additional Plants"), Lessee shall pay to Lessor during the remainder of the full term of the Lease, royalties as provided at Subparagraphs 5.2, 5.3, 5.4, 5.6 and 5.7 above.

If the Company opens another plant or plants in addition to the existing plant, and employment at the existing plant is lost as a result of such openings, so far as is reasonably practicable, affected employees who are unlikely to be recalled to the existing plant shall be offered employment at the other plant or plants in accordance with their seniority at the exist ing plant. Employees who are unable or unwilling to be placed in positions at the other plant or plants shall be treat ed as though terminated as the result of a permanent partial plant closure.
