Common use of Additional or Inconsistent Terms Clause in Contracts

Additional or Inconsistent Terms. Any term or condition set forth in any Purchase Order, proposal or other document provided by Seller to Buyer which is in any way different from, inconsistent with or in addition to the terms and conditions set forth herein will not become a part of this Purchase Order or be binding upon Buyer. Buyer’s failure to object to terms contained in any communications from Seller will not be a waiver of the terms set forth herein. Seller shall not condition any delivery upon the abrogation or modification of any of the terms and conditions included on this Purchase Order.
