Common use of Acquisition protocol Clause in Contracts

Acquisition protocol. 1. The provision of the Products in the presence of the Client will take place on the basis of a purchase protocol used by AnyWare in which the Products are inspected and any defects found are mentioned. The Client must sign the report drawn up by AnyWare with this description of the condition of the Products for approval before AnyWare provides the Products in use to the Client. Unless parties agree otherwise, the defects in the Products mentioned in the report shall be at AnyWare's expense. Upon discovery of defects, AnyWare and the Client will agree on the manner and term of repair of the defects listed. If parties have agreed that repair will be carried out by or on behalf of the Client, the repair work must be carried out properly and to the satisfaction of AnyWare. 2. If, for whatever reason, the Client does not cooperate properly with the purchase protocol as referred to in the previous paragraph, AnyWare reserves the right not to make the Products available.

Unless parties agree otherwise, the defects in the Products mentioned in the report shall be at AnyWareDual Inventive's expense. Upon discovery of defects, AnyWare Dual Inventive and the Client will agree on the manner and term of repair of the defects listed. If parties have agreed that repair will be carried out by or on behalf of the Client, the repair work must be carried out properly and to the satisfaction of AnyWareDual Inventive. 2.
