Common use of Acquired Property Clause in Contracts

Acquired Property. The Company agrees to comply with all Obligations set forth in any Underlying Collateral Document relating to Acquired Property unless, in the opinion of the Company, complying with the Obligations under such Underlying Collateral Documents would not be in the best interest (in terms of maximizing the value of the Loan) of the Company and the Initial Member. Pursuant to the provisions of Section 3.1 hereof, the Initial Member may require the Company to prepare and furnish special warranty deeds and other applicable Transfer Documents, for the Initial Member’s approval, to convey the Receiver Acquired Property to the Company.

Acquired Property. The Company agrees to comply with all Obligations set forth in any Underlying Collateral Document relating to Acquired Property unlessunless (subject in any event to Section 8.13 hereof), in the opinion of the Company, complying with the Obligations under pursuant to such Underlying Collateral Documents would not be in the best interest (in terms of maximizing the value of the LoanAsset) of the Company and the Initial Member. Pursuant to the provisions of Section 3.1 hereof, the Initial Member Transferor may require the Company to prepare and furnish special warranty deeds and other applicable Transfer Documents, for the Initial MemberTransferor’s approval, to convey the Receiver Acquired Property to the Company.
