Common use of ACL Clause in Contracts

ACL. 11.1. In respect of supplies of Goods, Adelaide EPV limits its liability for breach of consumer guarantees under the ACL to Adelaide EPV’s choice of the following: 11.1.1. the replacement of the Goods or the supply of equivalent Goods; 11.1.2. the repair of the Goods; 11.1.3. the payment of the cost of replacing the Goods or of acquiring equivalent Goods; or 11.1.4. the payment of the cost of having the Goods repaired. 11.2. In respect of supplies of Services, Adelaide EPV limits its liability for breach of consumer guarantees under the ACL to Adelaide EPV’s choice of the following: 11.2.1. the supplying of the Services again; or 11.2.2. the payment of the cost of having the Services supplied again. 11.3. Nothing in this Agreement is to be taken to limit the liability of Adelaide EPV to a greater extent than permitted by s64A of the ACL. 11.4. The Customer acknowledges that Adelaide EPV does not provide Goods or Services which are to be used for personal, domestic or household use.
