Common use of Achievement Clause in Contracts

Achievement. 13.1. YachtZap does not represent that any result or objective, whether stated in this agreement or not, shall be achieved. 13.2. YachtZap shall have no liability under or be deemed to be in breach of this agreement for any delays or failures in performance of this agreement, or the Charter Agreement, that result from circumstances beyond the reasonable control of YachtZap.

YachtZap shall have no liability under or be deemed to be in breach of this agreement for any delays or failures in performance of this agreement, or the Charter Agreement, that result from circumstances beyond the reasonable control of YachtZap. 15.3. Delays or failures in performance of any obligation under the Charter Agreement shall not affect the Owner’s obligations under Clause 4.
