Common use of Account Transactions Clause in Contracts

Account Transactions. 4.1 The Manager will place orders for the execution of transactions on behalf of the Trust Account on a best execution basis and in accordance with Part II of the Manager’s Form ADV, as may be amended from time to time. The Manager may, in its discretion, bunch and aggregate orders for the Account. The Manager is not required to aggregate orders. The Manager hereby notifies the Beneficiary that aggregation may work against as well as for the Account’s interest.

Account Transactions. 4.1 5.1 The Manager will place orders for the execution of transactions for the Account on behalf of the Trust Customer. When executing transactions or placing orders with other entities for execution that result from decisions by the Manager to deal when providing the service of portfolio management for the Account on behalf of the Customer, the Manager shall take all reasonable steps to obtain on a best execution basis and (in accordance with Part II of the Manager’s Form ADV, such manner as that obligation may be amended from time to time. The Manager may, satisfied under the Rules) and shall act in good faith and with due diligence in its discretion, bunch choice and aggregate orders for the Account. The Manager is not required to aggregate orders. The Manager hereby notifies the Beneficiary that aggregation may work against as well as for the Account’s interestuse of any counterparties.
