ACCIDENT TESTING. Such testing may be required when an employee is involved in a Class A, B, or C mishap. Mishap categories are periodically updated by DoD to adjust dollar values. At the time of this MLA, DoD Instruction 6055.7 defines mishaps as follows:
ACCIDENT TESTING. Any accident involving a CDL vehicle must be reported as soon as possible by the employee to his /her supervisor. The supervisor should investigate the circumstances of the accident and determine if there is reasonable suspicion to require a drug and alcohol test. Testing is mandated in the following circumstances: - An accident that has resulted in the loss of human life. - An accident in which the driver receives a citation and there is an injury requiring medical attention away from the scene of the accident. - An accident in which the driver receives a citation and any vehicle in the accident must be towed from the scene. Additional rules under the Federal Transit Act apply to City mechanics who have worked on a Transit vehicle involved in an accident and their immediate supervisor. An individual in a safety-sensitive position, such as a mechanic, is subject to drug and alcohol testing, when in the opinion of a supervisor, employee performance caused or contributed to the accident. For example, a mechanic would be tested when he/she worked on a Transit coach's brakes just prior to an accident and a brake problem may have contributed to the accident. A post-accident drug and alcohol test should be completed as soon as possible. Drug testing must occur no later than 32 hours after the accident. Alcohol testing must occur no later than 8 hours after the accident. If more than two hours elapse before an alcohol test is administered, the City is required to prepare and maintain on file an explanation of why a test was not properly administered for the FHWA. A driver is prohibited from consuming alcohol for 8 hours after an accident, or until he/she has taken a drug and alcohol test. Note: a police officer investigating an accident has legal authority under certain circumstances to order a blood sample to be taken for drug and alcohol testing.
ACCIDENT TESTING. Whenever an employee is involved in an accident on Selectemp property or our customers property, during the conduct of Selectemp business, or during working hours, and (1) the accident results in physical injury to the employee or other employees, or (2) the accident results in lost work time or damage to Selectemp or customer property (in accordance with the customer’s policies), or (3) where alcohol or drug use may have been a factor, Selectemp will require the employee to submit to drug and alcohol testing. An employee who tests positive for drugs or alcohol as a result of a post-accident test will be subject to discipline, up to and including immediate discharge. PRE-EMPLOYMENT TESTING: Consistent with this Policy, drug and alcohol testing may be administered to all final candidates for hire regardless of the position being filled, and each offer of employment shall be conditioned upon the passing of a test for drugs and alcohol. Selectemp will not hire any applicant who fails to pass the pre-employment drug or alcohol test.
ACCIDENT TESTING. Safety-sensitive employees will be required to undergo controlled substance and/or breath alcohol testing if they are involved in an accident with a District vehicle that results in a fatality. This includes all safety-sensitive employees who are on duty in the vehicles and any other whose performance could have contributed to the accident. In addition, a post-accident test will be conducted if an accident results in injuries requiring transportation to a medical treatment facility; or where one or more vehicles incurs disabling damage that requires towing from the site; and the safety-sensitive employee receives a citation under State of local law for a moving traffic violation arising from the accident. Following an accident, the safety-sensitive employee will be tested as soon as possible, but not to exceed eight hours for alcohol and 32 hours for controlled substances. Any employee who leaves the scene of the accident without appropriate authorization prior to submission to controlled substance and alcohol testing will be considered to have refused the test and subject to termination. Post-accident testing of safety-sensitive employees will include not only the operation personnel, but any other covered employees whose performance could have contributed to the accident.
ACCIDENT TESTING. The City is committed to providing a safe and secure work environment. Employees involved in on-the-job accidents or who engage in unsafe on-duty job-related activities that pose a danger to themselves or others or the overall operation of the City, may be subject to testing. Based on the circumstances of the accident or unsafe act, the City’s Risk Manager, Human Resource representative, Department Director or designee may initiate testing when such circumstances involve:
ACCIDENT TESTING. Any employee involved in an on the job accident or injury under circumstances that suggest possible use or influence of drugs or alcohol in the accident or injury event may be asked to submit to a drug and/or alcohol test. " Involved in an on the job accident or injury" means not only the one who was or could have been injured , but also any employee who potentially contributed to the accident or injury event in any way. If an employee is tested for drugs or alcohol outside of the employment context and the results indicate a violation of this policy, or in an employee refused a request to submit to testing under this policy, the employee may be subject to appropriate disciplinary action, up to and possibly including discharge from employment. In such a case the employee will be given an opportunity to explain the circumstances prior to any final employment action becoming effective.
