Common use of ACCESS TO COURTS Clause in Contracts

ACCESS TO COURTS. Notwithstanding the provisions of paragraphs 8.1 and 8.2 above, any action by Netgateway to enforce its rights under Paragraphs 10.1 or 10.3 of this Agreement or to enjoin any infringement of the same by Subscriber may, at Netgateway's election, be commenced in the state or federal courts of Los Angeles, California, and Subscriber consents to personal jurisdiction and venue in such courts for such actions.
