Common use of Access to and Use of Data Clause in Contracts

Access to and Use of Data. Because of the program’s interest in tracking student enrollment, performance and attendance data, the District will identify a clear protocol for AVID/TOPS/College Club staff to access MMSD student information within the regulations outlined by FERPA – the Family Educational Rights and Privacy Act – and the Wisconsin State Statutes governing the use of pupil records. These guidelines will include parameters and timelines to be used for sharing student information (demographics, grade / attendance data etc.) at the local school level, between partners and in public settings. The guidelines will cover written reports, public relations materials, fundraising documents, Internet and/or other print-based or electronic media. MMSD and BGC will share program information, enrollment and achievement data as needed for each entity to complete reports as needed. All data shared will be done in compliance with MMSD data sharing agreements mentioned above.
