Common use of Access and Availability Clause in Contracts

Access and Availability. Licensees will have perpetual access to content from the paid subscription year(s) starting with the 2013 subscription year. Licensees will have access to all back content not previously purchased if they have a current subscription, and if they have subscribed for the two previous consecutive years. Since ▇▇▇▇▇▇▇ publications were not available online until 2013, subscribers prior to 2013 will not have online access to previous back content unless they purchase a 2013 subscription. ▇▇▇▇▇▇▇ Publishing Company, Inc., either directly or through a contractor, shall use all reasonable endeavors to make access available on a 24-hour basis. But if access is suspended or interrupted or a defect occurs that prevents access, ▇▇▇▇▇▇▇ Publishing Company, Inc.’s liability shall be limited to using all reasonable efforts to restore access as soon as is reasonably practicable
