Common use of Acceptance of Rent Clause in Contracts

Acceptance of Rent. If Landlord shall direct Tenant to pay Base Rent and/or Additional Rent to a lockbox or other depository whereby checks issued in payment of Base Rent and/or Additional Rent (or both or all, as the case may be) are initially cashed or deposited by a person or entity other than Landlord (albeit on Landlord's authority), then, for any and all purposes under this Lease: (i) Landlord shall not be deemed to have accepted such payment until ten (10) days after the date on which Landlord shall have actually received such funds, and (ii) Landlord shall be deemed to have accepted such payment if (and only if) within said ten (10) day period, Landlord shall not have refunded (or attempted to refund) such payment to Tenant. Nothing contained in the immediately preceding sentence shall be construed to place Tenant in default of Tenant's obligation to pay rent if and for so long as Tenant shall timely pay the rent required pursuant to this Lease in the manner designated by Landlord.

Acceptance of Rent. If Landlord shall direct Tenant to pay Base Rent and/or or ------------------ Additional Rent to a lockbox "Lockbox" or other depository whereby checks issued in payment of Base Rent and/or or Additional Rent (or both or allboth, as the case may be) are initially cashed or deposited by a person or entity other than Landlord (albeit on Landlord's authority), then, for any and all purposes under this Lease: (i) Landlord shall not be deemed to have accepted such payment until ten (10) days after the date on which Landlord shall have actually received such funds, and (ii) Landlord shall be deemed to have accepted such payment if (and only if) within said ten (10) day period, Landlord shall not have refunded (or attempted to refund) such payment to Tenant. Nothing contained in the immediately preceding sentence shall be construed to place Tenant in default of Tenant's obligation to pay rent Rent if and for so long as Tenant shall timely pay the rent Rent required pursuant to this Lease in the manner designated by Landlord.

If Landlord shall direct Tenant to pay Base Rent, Adjusted Rent and/or Additional Rent to a lockbox or other depository whereby checks issued in payment of Base Rent, Adjusted Rent and/or Additional Rent (or both or all, as the case may be) are initially cashed or deposited by a person or entity other than Landlord (albeit on Landlord's authority), then, for any and all purposes under this Lease: (i) Landlord shall not be deemed to have accepted such payment until ten (10) days after the date on which Landlord shall have actually received such funds, and (ii) Landlord shall be deemed to have accepted such payment if (and only if) within said ten (10) day period, Landlord shall not have refunded (or attempted to refund) such payment to Tenant. Nothing contained in the immediately preceding sentence shall be construed to place Tenant in default of Tenant's obligation to pay rent if and for so long as Tenant shall timely pay the rent required pursuant to this Lease in the manner designated by Landlord.

If Landlord shall direct Tenant to pay Base Rent, Adjusted Rent and/or Additional Rent to a lockbox or other depository whereby checks issued in payment of Base Rent, Adjusted Rent and/or Additional Rent (or both or all, as the case may be) are initially cashed or deposited by a person or entity other than Landlord (albeit on Landlord's authority), and if, for whatever reason, Landlord does not wish to accept Tenant's payment, then, for any and all purposes under this Lease: (i) Landlord shall not be deemed to have accepted such payment until ten (10) days after the date on which Landlord shall have actually received such funds, and (ii) Landlord shall be deemed to have accepted such payment if (and only if) within said ten (10) day perioddays after Landlord shall have actually received such funds, Landlord shall not have has refunded (or attempted to refund) such payment to Tenant. Nothing contained in the immediately preceding sentence shall be construed to place Tenant in default of Tenant's obligation to pay rent if and for so long as Tenant shall timely pay the rent required pursuant to this Lease in the manner designated by Landlord.

Nothing contained in the immediately preceding sentence shall be construed to place Tenant in default of Tenant's obligation to pay rent Rent if and for so long as Tenant shall timely pay the rent Rent required pursuant to this Lease in the manner designated by Landlord.

Acceptance of Rent. If Landlord shall direct Tenant Tenant, in writing, to pay Base Rent or additional rent and/or Additional Rent other sums due hereunder (i) to a lockbox cash management or "lockbox" account or other depository whereby checks issued or (ii) by wire transfer, then Tenant shall not be in default of Tenant's payment obligations if and for so long as Tenant shall timely and accurately comply with Landlord's written instructions in connection with such payments, provided, however, that: (a) such payments are made in the full amount due without deduction, setoff or conditional or restriction endorsement and (b) in the event of Base Rent and/or Additional Rent any payment made net of a deduction or setoff or by an instrument which contains a conditional or restriction endorsement (or both or all, as the case may be) are initially cashed or deposited by a person or entity other than Landlord (albeit on Landlord's authority), then, for any and all purposes under this Lease: (i"For Deposit Only") Landlord such payment shall not be deemed to have been accepted such payment until ten (10) days after the date on which Landlord such funds shall have actually received such funds, been deposited in Landlord's account and (ii) Landlord shall be deemed to have accepted such payment if (and only if) within said ten (10) day period, Landlord shall not have refunded (or attempted to refund) such payment to Tenant. Nothing contained in the immediately preceding sentence shall be construed Landlord does not currently use either of these methods to place Tenant in default of Tenant's obligation collect rent, but reserves its right to pay rent if and for do so long as Tenant shall timely pay the rent required pursuant to this Lease in the manner designated by Landlordat some future time.
