Common use of Absence of Duties Clause in Contracts

Absence of Duties. Except in accordance with written instructions furnished pursuant to Section 8.1 or 8.2 hereof, and except as provided in, and without limiting the generality of, Sections 8.3 and 8.4 hereof, the Agent shall have no duty (i) to see to any recording or filing of any document, or to see to the maintenance of any such recording or filing, (ii) to see to any insurance on the Aircraft, whether or not the Lessee shall be in default in respect thereto, (iii) to confirm, verify or inquire into the failure to receive any financial statements or any other certificates, notices or correspondence, or (iv) to inspect the Aircraft at any time or ascertain or inquire as to the performance or observance of any of the Lessee’s covenants under the Lease with respect to the Aircraft.

Except in accordance with written instructions furnished pursuant to Section 8.1 or 8.2 hereof, and except as provided in, and without limiting the generality of, Sections 8.3 and 8.4 hereof, the Facility Agent shall not have no any duty (i) to see to any recording or filing of any document, or to see to the maintenance of any such recording or filing, (ii) to see to any insurance on the Aircraft, whether or not the Lessee shall be in default in respect thereto, (iii) to confirm, verify or inquire into the failure to receive any financial statements or any other certificates, notices or correspondence, or (iv) to inspect the Aircraft at any time or ascertain or inquire as to the performance or observance of any of the Lessee’s covenants under the Lease with respect to the Aircrafttime.
