A TRUSTEE. (i) shall not be responsible for any act or omission, unless such act or omission of the Trustee is a breach of the fiduciary standards set forth in Section 4.08; (ii) shall not be responsible for any act or omission of any accountant, counsel, or agent that is selected and monitored in accordance with the Trustee’s fiduciary duty pursuant to Section 4.08; and (iii) shall not be responsible for any selection, decision, or instruction made by the Employer.
