18 RIGHTS OF THE BOARD OF EDUCATION. 20 A. The Board on its own behalf and on behalf of the electors, hereby retains and reserves 21 unto itself, without limitation, all powers, rights, authority, duties, and responsibilities 22 conferred upon and vested in it by the laws and the Constitution of the Commonwealth of 23 Pennsylvania, and of the United States, including, and without limiting the generality of 24 the foregoing, the right: 26 1. To the executive management and administrative control of the school system and its 27 properties and facilities, and the job-related activities of its employees except as 28 specifically limited by this Agreement. 29 2. To hire all employees, to determine their qualifications and the conditions for their 30 continued employment, including their dismissal or demotion; and to promote and 31 transfer all such Employees subject to the provisions of the Pennsylvania School 32 Code, Act 195, Act 88 and this Agreement. 1 3. The exercise of the foregoing powers, rights, authority, duties and responsibilities by 2 the Board; the adoption of policies, rules, regulations and practices in furtherance 3 thereof; and the use of judgment and discretion in connection therewith shall be 4 limited only by the specific and express terms of the Constitution and laws of the 5 Commonwealth of Pennsylvania and the Constitution and laws of the United States. 6 4. Nothing contained herein shall be considered to deny or restrict the Board of its 7 rights, responsibilities, and authority under the Pennsylvania School Code or any 8 other national, state, county, district or local laws or regulations as they pertain to 11 B. The Employer agrees not to discriminate against any employee because of any activities 12 on behalf of the Association. Association activities shall not interfere with the normal 13 operation of the Employer, and the Association agrees that there shall be no unauthorized 14 Association activities during Employee work periods. 15 16 C. Neither the Employer nor the Association shall discriminate against any Employee or 17 applicant for employment on account of race, color, creed, sex, age, national origin, 18 religion, disability, veteran status, or any other protected characteristic in violation of 19 federal, state or local law. 20 21 ARTICLE V
