General. The Standard for uniformity in Construction Procurement published in terms of the Construction Industry Development Board (CIDB) Act, 2000 (Act no. 38 of 2000), the Standardized Construction Procurement Documents for Engineering and Construction Works as issued by the CIDB and any other relevant documentation pertaining thereto must be studied, and all principles in this regard must be applied to all procurement documentation, practices and procedures where applicable. It will be assumed that prices submitted by the contractor are based on Acts, Ordinances, Regulations, By-laws, International Standards and National Standards that were published at least 28 days before the closing date for tenders. The approved plans provides the scope of works for this project and were drawn by the architects for the Provincial Department of Human Settlements. It must be used for purposes of construction, and the final product must conform to the specifications provided in the approved plans. However, any ordering of materials, based on these plans, is at the Contractor’s risk and the tenderer’s attention is drawn to the fact that their prices must make allowance for all cut- offs, waste, spillage and any other provision that they may require in the execution of the work. In addition, the contractor shall appropriately allow in the price submitted for items such as temporary storage, unpacking, hoisting, pumping, placing or fixing in position, compacting, testing, waste, water, electricity, toilet-facilities and site- establishment. The amounts and rates to be supplied in the tender documents shall be the full inclusive amounts to the Employer for the works described in this project. Such amounts shall cover all the costs and expenses that may be required in and for the construction of the work described, and shall cover the costs of all general risks, profits, taxes (but excluding value-added tax), liabilities and obligations set forth or implied in the documents on which the Tender is based. 17.
