LIZENZVERGABE. 1.1. Taraflar arasında özel bir Yazılım Lisans Anlaşması yoksa, BAYKON MÜŞTERİ’ye, sipariş edilen yazılımı yalnızca MÜŞTERİ’nin dahili amaçları için kullanma konusunda münhasır olmayan, başkalarına kiralanmaz, alt lisansı yapılamaz, devredilemez bir kullanım lisansı mahiyetinde vermektedir. MÜŞTERİ, BAYKON’dan lisansladığı herhangi bir yazılımı ve ekli belgeleri değiştiremez, üçüncü bir tarafa dağıtamaz, paylaşamaz. 1.1. In the absence of a special Software Licence Agreement between the parties, BAYKON grants to the CUSTOMER a non-exclusive, non-rentable, non-sublicensable, non-transferable licence to use the ordered software solely for the internal purposes of the CUSTOMER. The CUSTOMER may not modify, distribute to a third party or share any software and attached documents licensed by BAYKON. 1.1. In Ermangelung einer speziellen Software-Lizenzvereinbarung zwischen den Parteien gewährt BAYKON dem KUNDEN eine nicht-exklusive, nicht-vermietbare, nicht-unterlizenzierbare, nicht-übertragbare Lizenz zur ausschließlichen Nutzung der bestellten Software ausschließlich für interne Zwecke des KUNDEN. Der KUNDE darf keine von BAYKON lizenzierte Software und zugehörige Dokumente ändern, an Dritte weitergeben oder teilen. 1.2. BAYKON Teklifleri, Siparişler ve/veya Sözleşmelerde aksi kararlaştırılmadıkça, “Kullanım”; MÜŞTERİ’nin dahili iş amaçları için bir cihaza herhangi bir zamanda yazılımın bir kopyasını kurma, depolama, yükleme, çalıştırma ve görüntülemesi anlamına gelmektedir. MÜŞTERİ’nin bu yazılımı kullanması bu lisans şartlarına ve varsa yazılım ile birlikte sağlanan veya Sipariş Belgelerinde BAYKON tarafından ilgili Yazılım için belirtilen kullanıcı sayısı, kullanım süresi ve benzeri izinlere ve kısıtlamalara tabidir. (“Yazılım Lisansı”). Bu şartlar arasında bir uyuşmazlık olması durumunda öncelik sırası, ilgili Sipariş Belgeleri ve ardından bu bölümün şartları şeklinde olacaktır. 1.2. Unless otherwise agreed in the BAYKON Offers, Orders and/or Contracts, "use" means the installation, storage, loading, operation and display of a copy of the software on a device for the CUSTOMER's internal business purposes at any time. The CUSTOMER's use of the Software is subject to these licence terms and, if applicable, the number of users, duration of use and similar permissions and restrictions provided with the Software or specified by BAYKON in the Order Documents for the relevant Software ("Software Licence").
